The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The Board will not consider the portion of the applicant's request for correction of DD Form 214, block 11, by adding the entry S4 ASI, as this item will be addressed through an administrative correction: 3. The applicant states, in effect, there was an oversight in the preparation of his separation documents during out – processing. He contends he completed SERE – C and Airborne School and DD Form 214, block 14, is void of an entry for the military education training for these courses. He also request his S4 ASI to be listed on his DD Form 214, block 11. 4. On 26 May 2007, the applicant entered into the Regular Army and he was honorably released from active duty on 30 August 2017. His DD Form 214 shows the following entry: * block 14: * "ENG OFF BASIC, 2007" * "BASIC OFF LDR CRS, 2007" * "SNIPER EMPLOYMENT LEAD, 2009 * “SAPPER LEADER COURSE, 2010" * "ENG OFF ADVANCED, 2012" * is void of an entry for AIRBORNE SCHOOL, 2005 * is void of an entry for SERE – LEVEL C, 2009 * Block 18 (Remarks): "SEE ATACHED CONTINUATION SHEET" * Continuation Sheet: "PARACHUTIST BADGE" 5. A review of the applicant's record shows his ORB, Section VI – Military Education (Course – Year) provides the following entry: * "AIRBORNE – 2005" * "SERE (High Risk) – 2009" 6. The applicant provides a SERE certificate of completion for Level B and Level C on 3 May 2009. He does not provide evidence of his United States Army Airborne School military education or training. 7. The applicant’s records show: • Permanent Orders 351 – 02, Headquarters, United States Army Maneuver Support Center of Excellence, dated 17 December 2010, awarded him the Sapper Tab • FLW Form 1088, dated 17 December 2010, shows he graduated from the Sapper Leader Course • DA Form 4037, dated 10 January 2016, authorized him the ASI S4 8. Army Regulation 635 – 8 (Separation Processing and Documents) states, for block 14 (Military Education) list all formal, in-service (full time attendance) training courses successfully completed during the period of service covered by the DD Form 214 of at least 1 week or 40 hours duration. This information is to assist the Soldier in job placement and counseling; therefore, do not list training courses for combat skills. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that partial relief is warranted. The applicant’s DD Form 214 for the period ending 30 August 2017 should be corrected to add: * In block 11 (Primary Specialty) – S4 (Additional Skill Identifier (ASI)) * In block 14 (Military Education) – Survival, Evasion, Resistance, and Escape (SERE), Level C. The Board found that the applicant attended parachute training prior to the period of active duty reflected on the DD Form 214 and therefore determined that absence of that training was not in error or unjust. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding on his DD Form 214 for the period ending 30 August 2017: • In block 11 (Primary Specialty), add S4 (Additional Skill Identifier (ASI)) • In block 14 (Military Education), add Survival, Evasion, Resistance, and Escape (SERE), Level C. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635 – 8 (Separation Processing and Documents), in effect, provides the DD Form 214 is a summary of the Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty (REFRAD), retirement, or discharge. The DD Form 214 is not intended to have any legal effect on termination of a Soldier’s service. For block 14 (Military Education) list all formal, in- service (full time attendance) training courses successfully completed during the period of service covered by the DD Form 214 of at least 1 week or 40 hours duration. Include course title, length in weeks, and year completed. This information is to assist the Soldier in job placement and counseling; therefore, do not list training courses for combat skills. Acceptable source documents include the enlisted record brief, DA Form 4037 (Officer Record Brief), DA Form 1059 (Service School Academic Evaluation Report), or other military issued certificate of completion with from and through dates or number of weeks. //NOTHING FOLLOWS//
