The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states: * the Kuwait Liberation for Kuwait and Saudi Arabia were never issued or awarded to him * he earned the German Armed Forces Marksmanship Badge (Schützenschnur) in Bronze but the information was never added to his DD Form 214 * he was also awarded the Army Commendation Medal and the Army Achievement Medal but they were never added to his DD Form 214 3. The available records are a sufficient basis to administratively correct the applicant's record to show award of the Army Commendation Medal, Kuwait Liberation Medal (Kingdom of Saudi Arabia), Kuwait Liberation Medal (Government of Kuwait), and Valorous Unit Award. These awards will not be discussed further in these in these Record of Proceedings. 4. The Board will address the applicant's request pertaining to award of the German Armed Forces Marksmanship Badge (Schützenschnur) in Bronze and the Army Achievement Medal. 5. The applicant enlisted in the Regular Army on 10 April 1990. He served in Southwest Asia from 30 December 1990 to 4 May 1991. 6. His DA Form 2-1 shows in: a. item 5 (Oversea Service) – temporary duty in Saudi Arabia for the period 30 December 1990 to 4 May 1991, b. item 9 (Awards, Decorations, and Campaigns) – no award of the Army Achievement Medal and c. item 35 (Record of Assignments) – he was assigned to Company B, 2nd Battalion, 70th Armor, from 15 August 1990 to 28 July 1992 in Germany. 7. On 29 July 1992, he was honorably released from active duty. His DD Form 214 does not show award of the German Armed Forces Marksmanship Badge (Schützenschnur) in Bronze or the Army Achievement Medal. 8. Department of the Army General Orders Number 12, dated 13 May 1994, awarded the Valorous Unit Award to Headquarters and Headquarters Company, 2d Brigade, 1st Armored Division, and subordinate units which included 2d Battalion, 70th Armor, for the period 26 to 28 February 1991. 9. He provided a certificate awarding him the German Armed Forces Marksmanship Badge (Schützenschnur) in Bronze. 10. His records are void of a certificate or orders authorizing his award of the Army Achievement Medal. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found the available evidence supports a recommendation for partial relief. 2. The available records contain no evidence, such as orders or a certificate, confirming the applicant was awarded the Army Achievement Medal. The Board agreed that there is no evidentiary basis for adding this award to his DD Form 214. 3. The applicant provided a certificate confirming he was awarded the German Armed Forces Marksmanship Badge (Schützenschnur) in Bronze. The Board agreed that this certificate is a sufficient basis upon which to add the badge to his DD Form 214. The Board also concurred with the administrative corrections described below. In addition to the corrections in the Administrative Note(s) that follow, the Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to his DD Form 214 for the period of service ending 29 July 1992, in item 9, the German Armed Forces Marksmanship Badge (Schützenschnur) in Bronze. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to the Army Achievement Medal. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. a. The Army Achievement Medal is awarded to members of the Armed Forces of the United States, who while serving in a noncombat area on or after 1 August 1981, distinguished themselves by meritorious service or achievement. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required. b. Table D-1 lists foreign badges authorized for acceptance and wear on the Army uniform. The German Armed Forces Marksmanship Badge (Schützenschnur) is listed as an award for officers.
