The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states: a. Her overseas tour in South Korea included a campaign during Operation Panther Shield during the nuclear crisis in 1994. President Clinton ordered her unit to set up Patriot missiles in Suwon. It was considered a combat zone due to a no-fly zone in the area. Her foreign service was from April 1994 through October 1994. b. She was not available to sign her DD Form 214 and did not review it before it was issued. She received an Army Achievement Medal and Certificate of Achievement for her service during Operation Panther Shield. 3. The applicant provided DA Form 638, dated 6 January 1995, awarding her the Army Achievement Medal. Her DA Form 2-1 also supports award of the Korea Defense Service Medal. These records support an administrative correction to her DD form 214 and these issues will not be mentioned further in this record of proceedings. The Board will consider her request for foreign service credit based on her service in South Korea and annotation of her DD Form 214 to show the award of Certificate of Achievement. 4. On 2 September 1992, she enlisted in the Regular Army. 5. The DA Form 2-1 shows in: a. item 5 (Oversea Service): (1) from 12 April 1993 through 31 August 1993, Saudi Arabia; 4 months and 19 days; and (2) from April 1994 through October 1994, Korea. b. item 35 (Current and Previous Assignments), effective date, duty military occupation specialty (MOS), organization and station or oversea duty: (1) 31 March 1993 through 26 April 1994, 52D (power generation equipment repairer), 2nd Battalion, 7th Air Defense Artillery (Rear Detachment), Fort Bliss, TX; and (2) 27 April 1994, [no MOS entered], 507th Maintenance Company, 2nd Battalion, 7th Air Defense Artillery, Fort Bliss, TX. 6. On 9 February 1995, she was discharged from the Regular Army and transferred the U.S. Army Control Group (Annual Training). Item 12f (Foreign Service) of the DD Form 214 shows "00" years, "09" months, and "26" days. 7. The DA Form 2-1 contains a hand-written entry indicating the month and year she deployed to and returned from Korea ("9404-9410," i.e., April 1994-October 1994) but does not show the days of the month with the entry. 8. Her records contain no orders showing the specific dates she deployed to and returned from Korea. 9. The applicant provided DA Form 638, dated 27 September 1994, showing award of a certificate of achievement. 10. Army Regulation 635-8 (Separation Processing and Documents) prescribes policy and procedural guidance relating to transition management. In item 13 of the DD Form 214 it stated to list all federally recognized awards and decorations for all periods of service. Do not use abbreviations. Do not enter foreign or State level awards on DD Form 214. A Certificate of Achievement is not considered to be an award or decoration. 11. Army Regulation 640-2-2 (Personnel Qualification Records) in effect at the time, proved for the method of recording information on the DA Form 2-1. Table 3-1 provided instructions for recording entries on the DA Form 2-1. In item 5 it stated to enter all overseas service performed under the authority of the DOD. The regulation made no provision for entering campaigns or operations in this block. BOARD DISCUSSION: After review of the application and all evidence, and in addition to the administrative notes below the signature, the Board determined that there is sufficient evidence to grant partial relief. 1. Regarding the applicant’s request for the Army Achievement Medal, per administrative notes below there is sufficient evidence to grant relief. Also, the Analyst found the applicant is also authorized the Korea Defense Service Medal, which is not reflected on her DD Form 214. 2. Regarding the applicant’s request to have her foreign service supporting Operation Panther Shield in the Republic of Korea, there is sufficient evidence that she served there from 1 March to 15 October 1994. 3. Regarding the applicant’s request to have foreign service in Southwest Asia added to her DD Form 214, the Board found insufficient evidence to add this as it is already reflected on her DD Form 214 in item 18 (Remarks). 4. Regarding her request to add a certificate of achievement to her discharge documents, the Board found insufficient evidence to grant relief as the Army does not add certificates to discharge documents. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending her DD Form 214 by adding a. to item 12f (Foreign Service) add the entry "1 years, 0 months, 2 days" vice “0 years, 9 months, 26 days,” b. and adding to item 18 (Remarks) "Service in ROK From 940301 To 941015." ADMINISTRATIVE NOTE(S): A review of the applicant's records shows she was authorized awards not shown on her DD Form 214 for the period 9 February 1995. As a result, amend the DD Form 214 by adding the Army Achievement Medal and Korea Defense Service Medal. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice.
