The applicant states his DD Form 214 does not show his award of the Combat Infantryman Badge. 3. The applicant enlisted in the Regular Army on 17 July 1985. 4. His DA Form 2-1 (Personnel Qualification Record) shows in: a. item 5 (Oversea Service) – * Germany from 28 September 1988 through 6 January 1991 * Saudi Arabia from 7 January 1991 through 13 May 1991 * Germany from 14 May 1991 through 26 September 1991 b. item 9 (Awards, Decorations & Campaigns) – * Sharpshooter Marksmanship Qualification Badge with Rifle Bar (M-16) * Expert Marksmanship Qualification Badge with Grenade Bar * Army Achievement Medal * Driver and Mechanic Badge with Driver-W Bar * National Defense Service Medal * Army Commendation Medal * Army Service Ribbon * Southwest Asia Service Medal with three bronze service stars * Kuwait Liberation Medal-Saudi Arabia * Marksman Marksmanship Qualification Badge with Machine Gun Bar (M-60) c. item 35 (Record of Assignments) – 7 January 1991 to 13 May 1991, Southwest Asia (no unit indicated). 5. On 1 April 1992, he was honorably released from active duty. His DD Form 214 shows in: a. item 11 (Primary Specialty) – military occupational specialty (MOS) 11B1O, Infantryman; b. item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) – * Army Service Ribbon * Army Achievement Medal * Driver and Mechanic Badge with Driver-W Bar * National Defense Service Medal * Army Commendation Medal * Southwest Asia Service Medal * Kuwait Liberation Medal * Marksman Marksmanship Qualification Badge with Machine Gun Bar (M-60) * Sharpshooter Marksmanship Qualification Badge with Rifle Bar (M-16) * Expert Marksmanship Qualification Badge with Grenade Bar 6. His available records are void of orders and evidence showing he was recommended for or awarded the Combat Infantryman Badge. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found that relief is warranted. 2. The Board noted the applicant was an infantryman assigned to an infantry unit when he deployed to Southwest Asia during Operations Desert Shield/Storm. Based on his service as an infantryman during Operation Desert Storm, the Board determined he met the criteria for award of the Combat Infantryman Badge and the badge should be added to his DD Form 214. 3. The Board further noted the applicant completed consecutive 3-year periods of service that made him eligible for award of the Army Good Conduct Medal. The Board determined the applicant's record should be corrected by awarding him the Army Good Conduct Medal (2nd Award), and the award should be added to his DD Form 214. 4. The Board concurred with the corrections described in Administrative Note(s) below. ADMINISTRATIVE NOTE(S): The applicant's DD Form 214 does not show his three bronze service stars to his previously-issued Southwest Asia Service Medal. Also, delete "Kuwait Liberation Medal" from this DD Form 214 and add "Kuwait Liberation Medal (Kuwait)" and "Kuwait Liberation Medal (Saudi Arabia)." REFERENCES: 1. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. a. The Combat Infantryman Badge is awarded to infantry or special forces officers and enlisted and warrant officer persons who have an infantry or special forces MOS. (1) They must have served in active ground combat while assigned or attached to an infantry, ranger, or special forces unit of brigade, regimental, or smaller size. Specifically, a recipient must be personally present and under hostile fire while serving in an assigned infantry or special forces primary duty in a unit actively engaged in ground combat with the enemy. (2) The unit in question must be a brigade, regiment, or smaller size. For example, personnel possessing an infantry MOS in a rifle squad of a cavalry platoon in a cavalry troop would be eligible for award of the Combat Infantryman Badge. Battle or campaign participation credit alone is not sufficient; the unit must have been in active ground combat with the enemy during the period. (3) Personnel with other than an infantry or special forces MOS are not eligible, regardless of the circumstances.
