ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS BOARD DATE: 6 March 2020 DOCKET NUMBER: AR20190006480 APPLICANT REQUESTS: correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the following awards: * Korea Defense Service Medal * Expert Marksmanship Qualification Badge with Rifle Bar (M-14) APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record), dated 10 March 2019 * DD Form 214 FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states the errors occurred due to an orderly room clerk's inaccurate documentation. 3. The available records are a sufficient basis to administratively correct the applicant's record to show award of the Korea Defense Service Medal. The Board will address the applicant's request for award of the Expert Marksmanship Qualification Badge with Rifle Bar. 4. The applicant enlisted in the Regular Army on 3 March 1964. 5. His DA Form 20 (Enlisted Qualification Record) shows in: * item 29 (Qualification in Arms) – he qualified as Marksman with the M-14 Rifle on 25 June 1967 * item 41 (Awards and Decorations) – he was awarded the Sharpshooter Marksmanship Qualification Badge with Rifle Bar (M-14) 6. His service record contains a copy of Headquarters, 2nd Missile Battalion, 71st Artillery, Special Orders Number 27, dated 4 February 1966, awarding him the Sharpshooter Marksmanship Qualification Badge with Rifle Bar (M-14). His records are void of orders showing he was awarded the Expert Marksmanship Qualification Badge with Rifle Bar. 7. On 2 March 1967, he was honorably released from active duty. His DD Form 214 does not show award of the Expert Marksmanship Badge with Rifle Bar. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board considered the applicant’s statement, his record of service, orders in his records and the awards shown on his DD Form 214 at separation. The Board found the applicant was eligible for award of the Korea Defense Service Medal, but found insufficient evidence to support award of the Expert Marksmanship Qualification Badge with Rifle Bar. Based on a preponderance of evidence, the Board determined that a correction to the applicant’s records was required. 2. After reviewing the application and all supporting documents, the Board found that partial relief was warranted.? The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending the DD Form 214 for the period of service ending 2 March 1967 to add to item 26 the KDSM as indicated in the Administrative Note(s) that follow. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to Expert Marksmanship Qualification Badge with Rifle Bar. I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. ADMINISTRATIVE NOTE(S): A review of the applicant's records shows he is authorized an additional award not listed on his DD Form 214. His DD Form 214 will be administratively corrected to show award of the Korea Defense Service Medal. ? REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) sets forth requirements for award of basic marksmanship qualification badges. The qualification badge is awarded to indicate the degree – Expert, Sharpshooter, and Marksman in which an individual has qualified in a prescribed record course.
