APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214 for the period ending on * SSN Card * Birth Certificate FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, U.S. Code, section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states the following: * she was given this SSN by her recruiter * the SSN was written on paper and was used until she was discharged * she never applied for a Social Security Card until she returned home * she tried to purchase a car and was informed this was not her SSN * if it is not corrected, my Social Security payments will not include her military service 3. The applicant provides: * her DD Form 214 which shows in item 3 (SSN) her SSN as XXX-XX-XXXX * a SSN card showing SSN XXX-XX-XXXX * State of Missouri birth certificate showing when and where she was born 4. A review of the applicant’s records show: * 3 May 1979 – enlisted in the US Army Reserve (USAR) as a Delayed Entry Program, a copy of the DD Form 4/1 (Enlistment/Reenlistment Document) shows she enlisted with the SSN XXX-XX-XXXX * 15 August 1979 – entered on active duty in the Regular Army (RA) * 4 February 1986 – honorably released from active duty 5. The SSN listed in the applicant’s records show XXX-XX-XXXX. The record is void, and the applicant did not provide, any evidence that she served with the SSN XXX-XX-XXXX. 6. Army Regulation 635-5 (Separations Documents), in effect during the applicant's active duty service, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It provided that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service, providing a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. For item 3 (Social Security Number (SSN)), enter SSN and verify accuracy of the SSN with Item 3 of the DA Form 2A for enlisted. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board considered the applicant’s statement, the documents in her record, the SSN card she provided and the SSN recorded on her DD Form 214. The Board found the applicant provided no supporting documents from the Social Security administration to show the date she was issued the SSN she now uses. Based on a preponderance of the evidence, the Board found that the SSN recorded in the applicant’s DD Form 214 was not in error or unjust. The Board advises the applicant that a copy of this decision will be placed in her official records to clarify the difference between her SSN in service and the SSN she uses today. 2. After reviewing the application and all supporting documents, the Board found that relief was not warranted. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. For item 3 (Social Security Number (SSN)), Verify accuracy of the SSN with Item 3 of the DA Form 2A for enlisted and DA Form 4037 for officers.
