The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he would like his name corrected. 3. The applicant enlisted in the Regular Army on 27 May 1994. His DD Form 4 (Enlistment Record – Armed Forces of the United States) shows he identified his name as "C.L.F." and signed his name the same way on the document. 4. The applicant was honorably released from active duty on 26 May 1997. Item 1 (Name – Last, First, Middle) of his DD Form 214 shows the spelling of his name as "C.L.F." 5. A review of his official military personnel file revealed all documents showing his name was spelled consistently as "C.L.F." throughout his military service. 6. The applicant provides a Superior Court of X County, State of X – Final Decree Changing the Name of an Adult that shows he petitioned for a name change and it was ordered changed to "C.F.C., Sr." on 5 February 2015. 7. Army Regulation 635-5 (Separation Documents), dated 15 August 1979, directed to enter the name in all capital letters. Include "Jr," "Sr," or "II" when needed, in item 1 at the time of separation. This regulation also provides that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found the requested relief is not warranted. 2. The Board noted the applicant's military records show he served exclusively under the name “C.L.F.,” which is accurately recorded on his DD Form 214. The Board agreed that in this case the applicant's post-service name change is not a basis for changing the name recorded on his DD Form 214. 3. The applicant is advised that a copy of this decisional document will be filed in his military personnel records. This should serve to clarify any questions or confusion regarding the difference between the name recorded in his military records and the name he now uses.
