The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states: a. The Meritorious Unit Commendation and Navy Unit Commendation were awarded to 362nd Engineer Company, 1st Marine Expeditionary Force, the unit to which he was assigned in Iraq. b. The Armed Forces Reserve Medal with "M" Device was awarded to him based on Headquarters, Task Force 321 Engineers, , memorandum, dated 27 November 2006. c. He completed tours in both Iraq and Korea. 3. The applicant's records contain sufficient evidence to support additional awards not shown on his DD Form 214. His DD Form 214 will be administratively corrected to show award of the Meritorious Unit Commendation, Navy Unit Commendation, Iraq Campaign Medal with two campaign service stars, and Overseas Service Ribbon with Numeral 2. These awards will not be discussed further in these Record of Proceedings. 4. The Board will consider his request for the award of Armed Forces Reserve Medal with "M" Device. 5. On 27 January 2004, the applicant enlisted in the Regular Army for 3 years. He held military occupational specialty 21C (Bridge Crewmember). 6. On 16 May 2006, Headquarters, U.S. Army Infantry Center, , Permanent Orders FB603, assigned him to report to Fort Benning, GA, en route to overseas assignment to Iraq and return, effective 2 July 2006, for 365 days, with action to deploy in support of operation Iraq Freedom Rotation 06-08. 7. His Enlisted Record Brief, dated 3 October 2007, shows in section I (Assignment Information) – he completed deployment combat duty in Iraq from 5 July 2006 through 3 July 2007. He was assigned to the 362nd Engineer Company. 8. On 7 October 2007, he was honorably released from active duty and transferred to U.S. Army Reserve Control Group (Reinforcement). His DD Form 214 shows in: a. item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) – he was awarded or authorized: * Army Achievement Medal * National Defense Service Medal * Global War on Terrorism Service Medal * Korea Defense Service Medal * Iraq Campaign Medal * Army Service Ribbon * Overseas Service Ribbon * Driver and Mechanic Badge with Driver Wheeled Vehicle(s) clasp b. item 23 (Type of Separation) – his type of separation as Release from Active Duty. c. item 28 (Narrative Reason for Separation) – the narrative reason for his separation as Completion of Required Active Service. 9. His record shows no evidence he was in an Army Reserve status while he was deployed to Iraq. 10. By regulation (AR 600-8-22), the Armed Forces Reserve Medal recognizes service members or former service members of the Reserve Components (including Active Guard Reserve (AGR)) who meet certain conditions. 11. The “M” device is authorized for wear on the Armed Forces Reserve Medal by members of the Reserve Components who are called to or who volunteer and serve on active duty in support of specific U.S. military operations or contingencies. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found partial relief is warranted. 2. The Board found the applicant did not meet the criteria for award of the Armed Forces Reserve Medal with "M" device. The available records show no evidence indicating the applicant was called to active duty as a member of a Reserve Component. The Board determined the applicant is not authorized this award. 3. The Board concurred with the corrections described in Administrative Note(s) below. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by making the corrections described in Administrative Note(s) below. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to the Armed Forces Reserve Medal with "M" device. ADMINISTRATIVE NOTE(S): A review of the applicant's records shows he was awarded or authorized the following awards not listed on his DD Form 214: * Meritorious Unit Commendation * Navy Unit Commendation * Iraq Campaign Medal with two campaign stars * Overseas Service Ribbon with Numeral 2 REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. a. The Armed Forces Reserve Medal was established, as announced in Department of Army (DA) Bulletin 15, dated 1950, and was amended by Executive Order (EO) 10439, announced in DA Bulletin 3, dated 1953 and EO 13013, dated 6 August 1996. The reverse of this medal is struck in two designs for award to personnel whose Reserve Component service has been primarily in the organized Reserve or primarily in the National Guard. The first design portrays the Minute Man from the Organized Reserve Crest; the other design portrays the National Guard insignia. b. The Armed Forces Reserve Medal recognizes service members or former service members of the Reserve Components (including Active Guard Reserve (AGR)) who have: (1) Completed a total of 10 years of honorable military service in the Reserve Components; (2) Been called to active duty and served under specific statutory conditions; or (3) Volunteered and served on active duty in support of designated US military operations or contingencies. c. The Armed Forces Reserve Medal is awarded by the unit commander for honorable and satisfactory Service as a member or former member of one or more of the Reserve Components of the Armed Forces of the United States, including the USCG Reserve and the USMC Reserve, for a period of 10 years under the following conditions: (1) Such years of service must have been performed within a period of 12 consecutive years. (2) Each year of active or inactive status honorable service prior to 1 July 1949 in any Reserve Component listed in Army Regulation 135-180 (Qualifying Service for Retired Pay Nonregular Service), will be credited toward award. For service performed on or after 1 July 1949, a member must accumulate, during each anniversary year, a minimum of 50 retirement points as prescribed in Army Regulation 135-180. (3) Service in a Regular Component of the Armed Forces, including the USCG, is excluded except that service in a Reserve Component which is concurrent in whole or in part with service in a Regular Component will be included. d. The 10 year-device is authorized for wear on the Armed Forces Reserve Medal to denote each 10 year-period as follows: (1) A bronze hourglass will be awarded upon completion of the first 10 year- period award. (2) A silver hourglass will be awarded upon completion of the second 10 year-period award. (3) A gold hourglass will be awarded upon completion of the third 10 year- period award. (4) A gold hourglass, followed by a bronze hourglass will be awarded upon completion of the fourth 10 year-award. (5) If no “M” device is authorized, the appropriate hourglass will be positioned in the center of the ribbon. e. The “M” device is authorized for wear on the Armed Forces Reserve Medal by members of the Reserve Components who are called to or who volunteer and serve on active duty in support of specific U.S. military operations or contingencies designed by the Secretary of Defense, as defined in Title 10 United States Code, Section 101(a)(13). //NOTHING FOLLOWS// ABCMR Record of Proceedings (cont) AR20190009052 5 1
