The applicant did not file within the three year time frame provided in Title 10, United States Code, section 1552(b); however, the ABCMR conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, his DD Form 214 does not list his military schools which he completed. He believes his separation documents including his DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty) should be corrected. 3. On 26 June 1991, the applicant enlisted into the Alabama Army National Guard (ALARNG). 4. A review of the applicant's record provides the following documents which show his military education or a corrections for his separation document(s): * DA Form 1059 (Service School Academic Evaluation Report), dated 9 November 1991 – PLDC (Reserve Component (RC) Number 002 -92) * DA Form 1059, dated 16 January 1994 – BNCOC (RC Phase I) * DA Form 1059, dated 26 July 1997 – Military Occupational Specialty (MOS) 51H3O (Army Construction Foreman) BNCOC Phase II Construction Engineer Supervisor 97-29) * DD Form 214 for the active duty period 15 March 2003 to 10 May 2004, block 14 shows "NONE//NOTHING FOLLOWS//" * DD Form 215, dated 17 November 2006, shows a correction for item 13: "ADD: COMBAT ACTION BADGE//NOTHING FOLLOWS//" 5. On 27 August 2005, the applicant was honorably released from the ALARNG. His NGB Form 22 (Report of Separation and Record of Service) shows: * item 10a (Net Service This Period) – 14 years, 0 months, and 0 days * item 10e (Total Service for Retired Pay) – 21 years, 2 months, and 2 days * item 12 (Military Education) – "PETRLM SUP SP CRS, 8WKS, 1983//PLDC, 2WKS, NOV 1991//BNCOC PH I, 2WKS, OCT 1994//BNCOC PH II, 2WKS, JUL 1997//NF" 6. Orders C06-095034, U.S. Army Human Resources Command, dated 4 June 2020, shows he was placed on the Army of the United States (AUS) retired list on 14 June 2020. 7. The applicant provides a DA Form 2-1 which shows his completion of: * PLDC * BNCOC – Phase I * BNCOC – Phase II 8. Army Regulation 635-5 (Separations Documents) states the DD Form 214 is a summary of a soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. The DD Form 214 is not intended to have any legal effect on termination of a soldier’s service. BOARD DISCUSSION: 1. After reviewing the application and all supporting evidence, the Board found insufficient evidence to grant relief. The applicant completed his training subsequent to the period of service covered by the DD Form 214 (15 March 2003 to 10 May 2005). Per regulation, the DD Form 214 is a summary of a Soldier’s most recent period of continuous active duty and, in the applicant’s case, provides a brief, clear-cut record of active duty service at the time of discharge. 2. The applicant is advised that a copy of this decisional document will be filed in his official military personnel file. This should serve to clarify any questions or confusion about the lack of his additional schools on his DD Form 214. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3 year statute of limitations if the Army Board for Correction of Military Records (ABCMR) determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) states the DD Form 214 is a summary of a soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. The DD Form 214 is not intended to have any legal effect on termination of a soldier’s service. This regulation provides for: a. Block 14 (Military Education) from the enlisted records brief/officer records brief (ERB/ORB), list formal in-service (full-time attendance) training course successfully completed during the period of service covered by the DD Form 214. Include title, length in weeks, and year completed. This information is to assist the soldier in job placement and counseling; therefore, do not list training courses for combat skills. b. Paragraph 2–7 (Issuing and reissuing DD Form 214) states once a DD Form 214 has been issued, do not reissue except for the following reasons: (1) When directed by proper appellate authority, Executive Order, or by the Secretary of the Army. (2) When it is determined that the original DD Form 214 cannot be properly corrected by issuance of a DD Form 215 or if the correction would require issuance of more than two DD Forms 215.
