The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states she married and changed her name. 3. The applicant enlisted in the Regular Army on 12 July 1992. Item 1 (Name – Last, First, Middle) of her DD Form 4 ((Enlistment/Reenlistment Document – Armed Forces of the United States) shows her last name as "X." Although not available in her record, it is assumed that subsequently she married and/or changed her last name to "X-X" during her period of service. 4. The applicant was honorably retired on 31 October 2013. Item 1 (Name - Last, First, Middle) of her DD Form 214 shows her last name as "X-X." 5. A review of her official military personnel file revealed all documents showing the last name of "X" or "X-X" throughout her military service. 6. She provides a marriage certificate that shows she was married on 21 July 2018, after her retirement, to a person with the last name of "X." 7. Army Regulation 635-5 (Separation Documents), dated 15 September 2000, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It states the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. For item 1, enter last name, first name, and full middle name or names, in all capitals and compare to applicable documents for name change, if any at the time of separation. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found the requested relief is not warranted. 2. The Board agreed that the applicant's DD Form 214 correctly shows the name she was using at the time of her retirement, and her post-retirement name change due to marriage is an insufficient basis upon which to recommend changing the name shown on her DD Form 214. 3. The Board noted that this Record of Proceedings will be provided to the applicant and will be filed in her record. This should serve to clarify any questions or confusion in regard to the difference between the name shown on her DD Form 214 and the name she now uses.
