The applicant did not file within the three-year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states: a. He attended airborne school in 1986 at Fort Benning, GA, and his award of the Parachutist Badge is not annotated on his DD Form 214. b. He and four other Soldiers with secondary military occupational specialty (MOS) 16S (Patriot/Missile Crewmember) were sent from Fort Bliss, TX, to Fort Benning, GA, to attend airborne training. They also attended additional air assault type training from helicopters at Fort Hunter Liggett, CA, and Fort Ord, CA, during the same period. 3. On 23 July 1985, the applicant enlisted in the Regular Army. 4. His DA Form 2-1 (Personnel Qualification Record), Part I, dated 21 July 1992, shows no airborne training in Section E (Training/Education Data). 5. His DA Form 2-1, Part II, shows in: a. item 9 (Awards, Decorations, and Campaigns) he was awarded or authorized the: * Army Service Ribbon * Army Good Conduct Medal (2nd Award) * Overseas Service Ribbon * National Defense Service Medal * Army Commendation Medal * Noncommissioned Officer Professional Development Ribbon * Army Achievement Medal * Southwest Asia Service Medal with two bronze service stars * German Armed Forces, Federal Republic of Germany, Achievement Badge- Bronze (German Armed Forces Proficiency Badge-Bronze) b. item 17 (Civilian Education and Military Schools) – he completed the Noncommissioned Officer Academy, Primary Leader Development Course, 4 weeks in 1990. There is no record of airborne training in this section. 6. On 27 December 1991, he was honorably released from active duty. His DD Form 214 shows in: a. item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized): * Army Service Ribbon * National Defense Service Medal * Southwest Asia Service Medal with two bronze service stars * Army Good Conduct Medal (2nd Award * Overseas Service Ribbon * Army Achievement Medal * Army Commendation Medal * Noncommissioned Officer Professional Development Ribbon * Sharpshooter Marksmanship Qualification Badge with Rifle Bar (M-16) * German Armed Forces Proficiency Badge-Bronze b. item 14 (Military Training) – Primary Leadership Development, 4 weeks, March 1990. 7. His records are void of orders showing he was awarded the Parachutist Badge. BOARD DISCUSSION: The Board found no evidence in the available records to corroborate the applicant's claim that he completed airborne school at Fort Benning in 1986. In the absence of such evidence, the Board determined the absence of the Parachutist Badge on his DD Form 214 is not an error or an injustice. If the applicant has any documentation corroborating his claim, he is encouraged to submit that documentation with a request for reconsideration. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. To be eligible for award of the basic Parachutist Badge, an individual must have satisfactorily completed the prescribed proficiency tests while assigned or attached to an airborne unit or the Airborne Department of the Infantry School, or have participated in at least one combat parachute jump as follows: a. A member of an organized force carrying out an assigned tactical mission for which the unit was credited with an airborne assault landing by the theater commander. b. While engaged in military operations involving conflict with an opposing foreign force. c. While serving with friendly foreign forces engaged in an armed conflict against an opposing armed force in which the United States is not a belligerent party. d. A bronze service star is authorized to be worn on Parachutist Badges to denote a Soldier’s participation in a combat parachute jump. e.
