Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20130003405 on 31 December 2013. 2. The applicant states that the ROKPUC was awarded to the Second Infantry Division in 2011 in defense of Korea for 60 years was approved for wear in 2017. 3. A review of the applicant’s available service records indicates the following: a. On 31 May 1963 after serving in the Army National Guard (ARNG), he enlisted in the United States Army. b. On 12 May 1966 he was released from active duty and transferred into the United States Army Reserve (USAR). c. On 9 August 1966 he reenlisted in the Regular Army. d. From 13 October 1972 through 21 September 1973 he served in the Republic of Korea; assigned to the 1st Squadron 9th Infantry Regiment, 2nd Infantry Division as a Career Counselor. e. On 26 March 1993 (Order# 085-176) he was released from the Army effective 31 August 1993 for retirement and placed on the Retired list effective 1 September 1993. 4. The applicant provides the following: a. General Order# 380 dated 15 August 1973 reflective of him being awarded the Army Commendation Medal for meritorious service while assigned the 1st of the 9th Infantry Battalion. b. DD Form 214 dated 31 August 1993 reflective him being released from active duty. His previous Foreign Service awards include the Armed Forces Expeditionary Medal (Korea) and the Overseas Service Ribbon. c. DD Form 215 (Correction of DD Form 214) dated 4 August 2004 reflective of the addition of the Korean Defense Service Medal and the Kuwait Liberation Medal-Kuwait to his 31 August 1993 issued DD Form 214. d. Information Paper for Enclosed Documents dated 23 April 2012 reflective of his period of Foreign Service being changed to reflect 5 years 3 months and 14 days. e. DD Form 215 dated 23 April 2012 reflective of the addition of 14 additional days of Foreign Service. f. DA Form 2-1 (Personnel Qualification Record) reflective of 12 months of foreign service in the Republic of Korea from 13 October 1972 through 21 September 1973. The document also contains award of the Armed Forces Expeditionary Medal (Korea) and the Overseas Service Ribbon. 5. The applicant did not provide nor does a review of his available military records reflect orders associated with the Republic of Korea Presidential Unit Citation. In 2011, the ROKPUC was awarded by the government of the Republic of Korea to members of the 2nd Infantry Division. The award was based on three 2nd Infantry Division accomplishments: • support provided the South Korean nation for over 60 years • training conducted with the ROK military • support provided following the Dongducheon flood of July 2011 This award may be temporarily worn by members of the 2nd Infantry Division during their assignment with the division. 6. On Docket Number AR20130003405 dated 31 December 2013, the Board denied his request for correction of his DD Form 214 to reflect award of the ROKPUC citing that the evidence of record shows the ROKPUC was awarded by the government of the Republic of Korea to members of the 2nd Infantry Division. Upon approval by Headquarters Department of the Army (HQDA), it may become permanently authorized for award, wear, and records annotation to past and present members of the 2nd Infantry Division. However, to date, such approval has not been granted by HQDA; therefore, until such time, he is not entitled to correction of his records to show this award. 7. BOARD DISCUSSION: After review of the application and all evidence, the Board found insufficient evidence to grant relief and amend the decision of the ABCMR set forth in Docket Number AR20130003405 dated 31 December 2013. The Board found that, to date, HQDA has still not granted approval for award of the ROKPUC to the 2nd Infantry Division. Therefore, until such time that HQDA approves it, he is not entitled to correction of his records to show this award. Army Regulation (AR) 600-8-22 (Military Awards) provides that the Republic of Korea Presidential Unit Citation (ROKPUC) is awarded by the Korean government. No more than one Republic of Korea Presidential Unit Citation will be worn by any individual and no oak leaf cluster or other appurtenance is authorized. All foreign unit awards must be confirmed in Department of the Army General Orders. There are no Department of the Army General Orders listed in Department of Army Pamphlet 672-3 confirming the Republic of Korea Presidential Unit Citation was issued to the 1st of the 9th Infantry Battalion, 2nd Infantry Division for the period of 13 October 1972 through 21 September 1973. 2. Department of the Army (DA) Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Roster) was published to assist personnel with determining or establishing the eligibility of individual members for campaign participation credit, assault landing credit, and unit citation badges awarded during the Vietnam Conflict, the Grenada Operation, and the period of service subsequent to the Vietnam Conflict up to September 1987. Additional unit awards are included for meritorious achievement in the continental United States (CONUS) and other foreign countries. This document reflects prior issuance of the ROKPUC to the following organizations: * 7th Infantry Division * 43rd Surgical Hospital 3. AR 600-8-22 (Foreign Award) provides that the ROKPUC is an honorary award. Unless specified, the award may only be accepted and retained; it is not authorized for wear on the U.S. Army uniform. 4. Army Regulation (AR) 15-185 (ABCMR) paragraph 2-9 states the ABCMR begins its consideration of each case with the presumption of administrative regularity.
