ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 21 October 2019 DOCKET NUMBER: AR20190011187 APPLICANT REQUESTS: correction of item 3 (Social Security Number (SSN)) of his DD Form 214 (Report of Separation from Active Duty) to show his SSN as instead of APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214, for the period ending 1 April 1975 * Photocopy of his Social Security Card FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his DD Form 214 contains the wrong SSN and item 27 (Remarks) of his DD Form 214 contains two other incorrect SSNs listed as and 3. The applicant's record includes a DD Form 398 (Statement of Personal History) and a Standard Form 93 (Report of Medical History) which both show his SSN as He signed both of these documents attesting to the accuracy of the information. 4. He enlisted in the United States Army Reserve (USAR) Control Group (Delay Entry) on 15 January 1975. Item 1 (Service No./SSN) of his DD Form 4 (Enlistment Contract - Armed Forces of the United States) shows his SSN as 5. Special Orders Number 23, dated 30 January 1975 discharged him from the USAR Control Group (Delay Entry) on 29 January 1975 for the purpose of entry onto active duty. These orders show his SSN as 6. He enlisted in the Regular Army on 30 January 1975. Item 1 of his DD Form 4 shows his SSN typed as however, the middle two digits were crossed out and was placed above them in pen with initials. 7. The applicant was honorably discharged on 1 April 1975. Item 3 (SSN) of his DD Form 214 shows his SSN as Item 27 contains the entry "Other SSAN of record: 8. A review of the applicant's available military records reveals he served under the contested SSN, as well as the others listed on his DD Form 214, throughout his entire period of active duty service. It does not contain the requested SSN as listed on social security card he provided. 9. Army Regulation 635-5 (Separation Documents), dated 20 August 1973, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It states to check records with separate's social security card when possible. Otherwise, verify the accuracy of the SSN of record in item 3. For other SSNs used during the period enter in item 27. BOARD DISCUSSION: The Board noted that there appear to been attempts made to correct the SSN while he was on active duty, but those attempts were not fully successful. The Board also noted that the iteration of the SSN in the record that is closest to the SSN shown on his social security card varies by only one digit (a "9" instead of an "8" in the seventh place), a difference that could easily be the result of a typographical or scribal error. Had the applicant served longer, the problem may have been resolved. The Board concluded that a preponderance of the evidence supports granting the requested relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by replacing the entry in item 3 (SSN) of his DD Form 214 for the period ending 1 April 1975 with the SSN shown on his social security card. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separations Documents), dated 20 August 1973, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. Item 3 states to check records with separate's social security card when possible. Otherwise, verify the accuracy of the SSN of record.
