APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Circuit Court of Pulaski, Missouri, Judgment for Change of Name of Adult Individual, dated 4 January 2019 FACTS: 1. The applicant states, in effect he legally changed his name from while he was on active duty. 2. The applicant's DD Form 214 for the period ending 7 June 2019 and all the other official records or documents in his military record reflect his name as . These documents include but are not limited to the below records: * DD Form 4 (Enlistment/Reenlistment Document – Armed Forces of the United States), dated 10 July 2014 * DD Form 1966 (Record of Military Processing – Armed Forces of the United States) * Army Commendation Medal from 24 June 2015 to 22 March 2019 3. The applicant provides a legal document, which shows he legally changed his name from to “DF” on 4 January 2019, prior to his date of separation. 4. His record is void of any documentation to show he requested a name change prior to his date of separation. 5. Army Regulation 635-8 (Separation Processing and Documents) states for item 1, enter last name, first name, and full middle name or names, if any at the time of separation. His name, at the time of his discharge on 7 June 2019 was . However, the applicant legally changed his name on 4 January 2019, prior to his date of separation; however, there is no documentation to show he submitted his legal name change order to his administrative department for action. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board considered the applicant’s statement, his record of service, the name appearing consistently throughout his records, the date of the court- ordered name change and the date of his discharge. The Board found no evidence that the applicant requested a name change while in-service, but also found that the applicant’s legal name change took place prior to his separation from service. Based on a preponderance of evidence, the Board determined that a correction to the applicant’s record was appropriate. 2. After reviewing the application and all supporting documents, the Board found that partial relief was warranted. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending the D Form 214 for the period of service ending 7 June 2019 as follows: - Item 18 (Remarks) – Add 2. The Board further determined the evidence presented is insufficient to warrant a portion of th requested relief. As a result, the Board recommends denial of so much of the application that pertains to changing the name shown in item 1 of the DD Form 214. REFERENCES: Army Regulation 635-8, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge.
