The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states she discovered the error in her DOB on her DD Form 214 when applying for a job. 3. The applicant enlisted in the U.S. Army Reserve on 17 May 1979 and subsequently enlisted in the Regular Army on 5 July 1979. Her DD Form 4 (Enlistment/Reenlistment Document Armed Forces of the United States) covering this enlistment shows her DOB year as 1961. 4. A DA Form 873 (Certificate of Clearance and/or Security Determination), dated 21 June 1979, lists her DOB year as 1961. 5. The applicant reenlisted in the Regular Army on 3 November 1988. Her DD Form 4 covering this enlistment shows her DOB year as 1960. 6. A DD Form 1172 (Application for Uniformed Services Identification Card – DEERS Enrollment), dated 1 March 1990, shows her DOB year as 1961. 7. The applicant reenlisted in the Regular Army on 11 March 1991. Her DD Form 4 covering this enlistment shows her DOB year as 1959. 8. A Standard Form 88 (Report of Medical Examination, dated 17 May 1993, shows her DOB year as 1959. A DD Form 1172, dated 1 June 1993, shows her DOB year as 1959. 9. She again reenlisted in the Regular Army on 15 July 1993. Her DD Form 4 covering this enlistment shows her DOB year as 1959. 10. The applicant was honorably discharged on 30 July 1993, under the provisions of the Fiscal Year 1993 Enlisted Voluntary Early Transition Program, after 14 years and 26 days of net active service. Her DD Form 214 shows her DOB year as 1959. 11. The applicant provided a Certificate of Registration showing her DOB year to be 1961. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief is warranted. Her DD Form 214 should be corrected to show her DOB year as 1961. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing her DOB year as 1961. I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers at the time of retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214. The general instructions stated all available records would be used as a basis for preparation of the DD Form 214. The instructions for completion of Item 5 (Date of Birth) state to enter the six-digit number: year, month, and day without spaces or slashes.
