ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 25 October 2019 DOCKET NUMBER: AR20190012114 APPLICANT REQUESTS: in effect, correction to item 11 (Primary Specialty) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 16 March 2017 to show he completed 1 year, 3 months, and 28 days in his Primary Specialty instead of 4 months. The applicant states, he would like to correct item 11 of his DD Form 214. Within item 11 of his DD Form 214, it shows that he only served four months on active duty; however, his period of enlistment is from 19 November 2015 to 16 March 2017. Although this is a small error, it is preventing him from utilizing his Post 9/11 Educational Benefits based on the fact that the VA Education Office will not recognize his enlistment dates within item 12f (Record of Service) of his DD Form 214. 2. On 19 November 2015, he enlisted in the Delayed Entry Program (DEP). 3. On 23 May 2016, he was discharged from the DEP and enlisted in the Regular Army. 4. His Enlisted Record Brief (ERB), Section IX (Assignment Information) shows he entered basic training on 24 May 2016. 5. Orders 302-00715, issued by U.S. Army Combined Arms Support Command (CASCOM), on 28 October 2016 states he was awarded military occupational specialty (MOS) 92G (Food Service Specialist), “Effective Date 09 Nov 2016 or upon course completion.” 6. The applicant’s record is void of any documentation that shows his MOS graduation date or a certificate to show the dates of his MOS. However, his ERB shows he arrived at his first permanent duty station, after completing advanced individual training, on 6 September 2016. 7. On 16 March 2017, he was honorably discharged from active duty due to a condition, not a disability. His DD Form 214 shows the following information: * item 11 – “92G1O FOOD SERVICE SPECIALIST – 0 YRS 4 MOS” * item 12c (Net Active Service This Period)- “0001 03 28” * item 14 (Military Education) – “CULINARY SPECIALIST, 8 WEEKS, 2017” 8. His record shows he was awarded his MOS on 9 November 2016 and he was honorably discharged on 16 March 2017. a. Subparagraph b., below, shows that the period between the date he was awarded his MOS and the date of his discharge equals 4 months and 8 days. b. 2017 03 16 (Date of Discharge) - 2016 11 09 (Date awarded MOS) 00 04 08 c. The instructions on the DD Form 214 for completing item 11 state to “list… [the] years and months in specialty.” 9. Army Regulation 635-8 states, to enter the titles of all MOS or areas of concentration (AOCs) awarded and held for at least 1 year during the current period of service and include for each MOS/AOC the number of years and months held. Do not count time in training (basic training, advanced individual training, Basic Officer’s Leader Course, or MOS-producing school).. 10. He provides a VA disability rating letter, and a letter from the VA Educational Benefits, which denied his claim for the Post-9/11 GI Bill due to insufficient qualifying active duty service after 10 September 2001. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board considered the applicant’s statement, his record and length of service, his time on the DEP, the dates of his completion of training and orders awarding him an MOS, the date of his arrival at his first duty station and the reason for his separation. The Board found insufficient evidence to show the applicant held the MOS he was awarded for the period of time he requests. Based on a preponderance of evidence, the Board determined that the length of time holding an MOS shown for the applicant upon separation was not in error or unjust. 2. After reviewing the application and all supporting documents, the Board found that relief was not warranted.
