The applicant states he requests his original orders to be amended to add a new line of accounting for 2019 so the Defense Finance and Accounting Service (DFAS) can reimburse him his final retirement move for personally owned vehicle travel from MD to FL in June 2019. His travel and transportation entitlement was extended annually from 2014 to 2019. DA Form 1351-2 (Travel Voucher or Subvoucher) was sent to DFAS and rejected due to an incorrect line of accounting. Extensions for movement of Household Goods (HHG) upon retirement are not sent to the U.S. Army Human Resources Command (HRC), so that retirement orders are simultaneously updated. 2. A review of the applicant's official records shows the following: a. On 14 September 1997, the applicant entered active duty in an Active Guard/Reserve status and served continuously until his retirement. b. On 12 December 2012, Orders Number C-12-217918, issued by HRC, Fort Knox, KY, attached the applicant to Fort Meade, MD for separation processing. c. On 30 June 2013, the applicant was honorably retired from active duty. He completed 15 years, 9 months, and 17 days of net active service, with 4 years, 5 months, and 8 days of prior active service, and 13 years and 15 days of prior inactive service. 3. The applicant provides: a. Orders Number P-12-290170, issued by HRC, retired the applicant from active duty, effective on 30 June 2013. b. Orders Number P-12-290170A01, issued by HRC, amended Orders Number P-12-290170 insomuch as changing the applicant's total number of active service years. c. Memorandum, Subject: Retiree Travel and Transportation Entitlement Final Extension showing the applicant's final request for an extension of his transportation entitlements was approved through 30 June 2019. 4. See applicable references below. BOARD DISCUSSION: After reviewing the application and all supporting evidence, the Board found that partial relief was warranted. 1. The Board found sufficient evidence that the applicant is entitled to reimbursement of his final retirement travel and transportation payment. The Board agreed that the applicant’s request for transportation entitlements was approved and should be granted. 2. The applicant's request for a personal appearance hearing was carefully considered. In this case, the evidence of record was sufficient to render a fair and equitable decision. As a result, a personal appearance hearing is not necessary to serve the interest of equity and justice in this case. ? Volume 1 (Uniformed Service Personnel) of the Joint Travel Regulation (JTR) contains basic statutory regulations concerning official travel and transportation of members of the uniformed services. Extension provisions to the 1-year time limit are also provided for deserving cases under the Secretarial process. This process allows for extensions based on an unexpected event beyond the member's control that prevents movement to a PDS within the specified time limit. An extension of the time limit may be authorized by the Secretarial process if it is in the best interest of the service or substantially to the benefit of the member and not costly or otherwise averse to the service. These extensions are approved for the specific period of time that the member anticipates is needed to complete the move, and if additional time is required, the member may request a further extension. Paragraph U5012-I of volume 1 of the JTR provides the policy on restrictions to time limit extensions and states that a written time limit extension that includes an explanation of the circumstances justifying the extension may be approved for a specific additional time using the Secretarial process. However, extensions under this process will not be authorized if it extends travel and transportation allowances for more than 6 years from the separation/retirement date. 2. Title 10 United States Code, section 1552 (c)(1) states the Secretary concerned may pay, from applicable current appropriations, a claim for the loss of pay, allowances, compensation, if, as a result of correcting a record under this section, the amount is found to be due the claimant on account of his service in the Army. 3. Army Regulation 15-185 (Army Board for Correction of Military Records (ABCMR)) prescribes the policies and procedures for correction of military records by the Secretary of the Army, acting through the ABCMR. The ABCMR may, in its discretion, hold a hearing or request additional evidence or opinions. Additionally, it states in paragraph 2-11 that applicants do not have a right to a hearing before the ABCMR.
