The applicant did not file within the three year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states: a. His service was active duty for training, not inactive duty for training. b. His American Legion Post suggested this correction. 3. The applicant enlisted in the Pennsylvania Army National Guard on 15 April 1967. 4. He was assigned to Battery F, 7th Training Battalion, Army Training Center, 4th U.S. Army. 5. On 21 July 1967, he was ordered to active duty for training. 6. On 20 November 1967, he was honorably released from active duty. His DD Form 214 shows in: a. item 17a (Current Active Service Other Than by Induction) – ordered to active duty for training; b. item 22a(1) (Net Service This Period) – 0 years, 4 months, and 0 days; c. item 22a(2) (Other Service) – 0 years, 3 months, and 0 days; d. item 22a(3) (Total) – 0 years, 7 months, and 6 days; e. item 22b (Total Active Service) – 0 years, 4 months, and 0 days; and f. item 24 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) – Marksman Marksmanship Qualification Badge with Rifle Bar (M-14). 7. On 14 April 1973, he was honorably discharged. His National Guard Bureau Form 22 shows in: a. item 24 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) – * Pennsylvania Service Ribbon * General Stewart Medal * Army Reserve Component Achievement Medal * Marksman Marksmanship Qualification Badge with Rifle Bar (M-16) * Marksman Marksmanship Qualification Badge with Pistol Bar (.45 caliber) b. item 26 (Length this Service) – 6 years, 0 months, and 0 days; and c. item 32 (Remarks) – He was ordered to active duty for training from 21 July 1967 to 20 November 1967. ? BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board considered the applicant’s statement, his record of service, the purpose of his active service (ACDUTRA) as a member of the ARNG and his return to his unit of assignment. The Board considered the criteria for award of the NDSM during his period of service. The Board found insufficient evidence to determine the reason for his period of active service. Based on a preponderance of evidence, the Board determined that the absence of the NDSM in the applicant’s records was not in error or unjust. 2. After reviewing the application and all supporting documents, the Board found that relief was not warranted.? Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3 year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. The National Defense Service Medal may be awarded for both active and reserve service as defined below. a. It is awarded for honorable active service for any period between (dates inclusive): (1) 27 June 1950 and 27 July 1954 (Korea). (2) 1 January 1961 and 14 August 1974 (Vietnam). (3) 2 August 1990 and 30 November 1995 (Persian Gulf). (4) 11 September 2001 to a date to be determined (Global War on Terrorism). b. During the periods listed for Korea and Vietnam, service members in the following categories will not be eligible for the National Defense Service Medal: (1) Members of the Army National Guard and U.S. Army Reserve on short tours of duty to fulfill training obligations under an inactive duty training program. (2) Any service member on temporary duty or temporary active duty to serve on boards, courts, commissions, and like organizations. (3) Any service member on active duty for the sole purpose of undergoing a physical examination. c. During the period listed for the Persian Gulf, service members on active duty, members of the Selected Reserve in good standing, and service members of other than the Selected Reserve who were called to active duty will also be eligible. Service members in the following categories will not be eligible for the National Defense Service Medal: (1) Any service member on active duty for the sole purpose of undergoing a physical examination. (2) Any Soldier of the Individual Ready Reserve, Inactive National Guard, or the Standby or Retired Reserve whose active duty service was for training only, or to serve on boards, courts, commissions, and like organizations. d. During the period for the Global War on Terrorism, service members on active duty, which includes extended eligibility for award of the National Defense Service Medal to the Selected Reserve in good standing will also be eligible. e. Notwithstanding these limitations, any member of the U.S. Coast Guard or the U.S. Army Reserve or Army National Guard Forces of the Armed Forces who, between 1 January 1961 and 14 August 1974, became eligible for award of either the Armed Forces Expeditionary Medal or the Vietnam Service Medal; or between 2 August 1990 and 30 November 1995, became eligible for award of the Southwest Asia Service Medal will be eligible for award of the National Defense Service Medal. f. To signify receipt of a second or subsequent award of the National Defense Service Medal, a bronze service star will be worn on the Service ribbon by U.S. Army personnel so qualified. A second or third award of the National Defense Service Medal is authorized for Soldiers who served in two or more of the four time periods listed above.
