The applicant did not file within the three year time frame provided in Title 10, United States Code, section 1552(b); however, the ABCMR conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant enlisted in the Regular Army on 25 August 1992. He was released from active duty on 1 March 2000. Item 18 (Remarks) of the DD Form 214 he was issued does not list his requested deployed service to Bosnia from 21 December 1995 to 21 June 1996. 3. Information obtained from the Defense Finance and Accounting Service, confirms the applicant performed foreign service in Bosnia-Herzegovina from 22 December 1995 to 3 June 1996. 4. Qualifying service for award of the AFEM includes participation in the former Republic of Yugoslavia for Operations Joint Endeavor and Joint Guard from 1 June 1992 to 20 June 1998 (only for participants deployed to Bosnia-Herzegovina and Croatia). 5. Military Personnel Message Number 99-100 authorized award of both the Armed Forces Service Medal (AFSM) and the AFEM, as a one-time exception to Department of Defense and Service policy, for qualifying service in support of Operations Joint Endeavor and Joint Guard in the Republic of Bosnia-Herzegovina. This exception allowed both service medals to be presented to personnel deployed in Bosnia- Herzegovina during the periods 1 June 1992 to 19 December 1996 (Operation Joint Endeavor) and 20 December 1996 to 20 June 1998 (Operation Joint Guard). 6. The applicable regulation states for an active duty Soldier deployed with his or her unit during their continuous period of active service, the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD- YYYYMMDD)" will be entered in item 18 of the DD Form 214. BOARD DISCUSSION: After reviewing the application and all supporting evidence, the Board found that partial relief was warranted. There is sufficient evidence to indicate that the applicant’s most recent DD Form 214, ending 1 March 2000 is absent important information regarding the applicant’s service. The applicant requests that his foreign service reflect service in Bosnia-Herzegovina from 21 December 1995 to 21 June 1996. However, the only evidence of his deployment is from DFAS records, which validate that the applicant served in Bosnia-Herzegovina from 22 December 1995 to 3 June 1996. Therefore, the Board ascertained that the applicant served in Bosnia-Herzegovina from 22 December 1995 to 3 June 1996, which is not recorded in item12f, the locations are not indicated in item 18 (remarks) and he is authorized the AFEM for this service that is not reflected in item 13 of his discharge document. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending his DD Form 214 ending 1 March 2000 as follows: a. item 12f (Foreign Service) add 5 months, 12 days (Bosnia-Herzegovina), b. item 13 (Decorations, Medals, etc.) add the AFEM, and c. item 18 (Remarks) add “Service in Bosnia-Herzegovina from 19951222 to 19960603.” 2. The Board recommends denial of that portion of the applicant’s request regarding foreign service from 21 December 1995 to 21 June 1996. I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3 year statute of limitations if the Army Board for Correction of Military Records (ABCMR) determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) states the AFEM is awarded for qualifying service after 1 July 1958 in U.S. military operations, U.S. operations in direct support of the United Nations, and U.S. operations of assistance for friendly foreign nations. Qualifying service for this award includes participation in the Former Republic of Yugoslavia for Operations Joint Endeavor and Joint Guard from 1 June 1992 to 20 June 1998 (only for participants deployed to Bosnia-Herzegovina and Croatia). 3. Military Personnel Message Number 99-100 authorized award of both the AFSM and the AFEM, as a one-time exception to Department of Defense and Service policy, for qualifying service in support of Operations Joint Endeavor and Joint Guard in the Republic of Bosnia-Herzegovina. This exception allowed both service medals to be presented to personnel deployed in Bosnia-Herzegovina during the periods 1 June 1992 to 19 December 1996 (Operation Joint Endeavor) and 20 December 1996 to 20 June 1998 (Operation Joint Guard). The exception also allowed only one award of each service medal for service in either or both Operation Joint Endeavor and Operation Joint Guard. 4. Army Regulation 635-5 (Separation Documents), then in effect, established the standardized policy for preparing and distributing the DD Form 214. Chapter 2 contains guidance on the preparation of the DD Form 214.
