IN THE CASE OF: BOARD DATE: 27 August 2020 DOCKET NUMBER: AR20190015264 APPLICANT REQUESTS: a change in the type of separation currently reflected on his DD Form 214 (Certificate of Release or Discharge from Active Duty) dated 21 June 1991. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214 dated 21 June 1991 FACTS: 1. The applicant states that he served on active duty during Operation Desert Shield / Desert Storm. His DD Form 214 reflects that this period of service was active duty training (ADT). During this time he believes that his unit, the 2488th Engineer Company, was deployed to assist with combat loading. He is currently homeless attempting to obtain services with a Veterans association in Worcester, Massachusetts, but is unable to do so because his DD Form 214 indicates that he was on ADT. He doesn’t understand why this type of separation was provided while serving in the middle of a wartime event. 2. A review of the applicant’s available service records reflects the following: a. On 6 February 1991 he enlisted in the Army National Guard (ARNG) for 8 years. b. On 25 February 1991 he was placed on active duty. c. On 21 June 1991 he was released from active duty under the provisions of Army Regulation 635-200 (Personnel Separations – Enlisted Personnel), Chapter 4 (Completion of Active Duty Training), by reason of relief from ADT. His DD Form 214 further reflects completion of 8 weeks of General Construction Equipment Operator Training in June 1991. d. On 31 March 1993 (Order 059-036) he was discharged from the ARNG and transferred to the United States Army Reserve (USAR) effective 1 April 1993. e. His ARNG Retirement Points History Statement reflects that from 25 February through 21 June 1991 he received 117 retirement points. This period of service was categorized as “B7” (unit member on initial entry training) under the Military Membership Status Identifiers (MMSI) portion of this document. f. On 9 February 1999 (Order D-02-906596) he was discharged from the United States Army Reserve (USAR) 3. The applicant provides his DD Form 214 dated 21 June 1991 – see 2c. above. 4. The applicant did not submit nor does review of his available personnel records reflect active duty service beyond the period served for initial entry training as currently reflected on his DD Form 214. 5. Army Regulation (AR) 15-185 (ABCMR) paragraph 2-9 states the ABCMR begins its consideration of each case with the presumption of administrative regularity. The applicant has the burden of proving an error or injustice by a preponderance of the evidence. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found that relief is not warranted. 2. The Board noted that the applicant was not on active duty in support of Operation Desert Shield/Desert Storm during the period covered by his DD Form 214. He was on active duty for initial entry training, and his DD Form 214 correctly shows that he was relieved from ADT upon completion of the training. The Board determined the reason for separation recorded on his DD Form 214 is not in error or unjust. Army Regulation (AR) 15-185 (ABCMR) paragraph 2-9 states the ABCMR begins its consideration of each case with the presumption of administrative regularity. The applicant has the burden of proving an error or injustice by a preponderance of the evidence. 2. AR 635-200 (Personnel Separations – Enlisted Personnel) provides that individuals who are discharged or released from AD or ADT will be furnished a factual record of their military service on DD Form 214. Chapter 4 (Separation for Expiration of Service Obligation) provides that a Soldier will be separated upon expiration of enlistment or fulfillment of service obligation. Soldiers of the ARNGUS and the USAR ordered to AD for a period in excess of 90 days will, upon release from AD revert to control of the appropriate Reserve Component. The service of soldiers specified in this paragraph who are in entry level status will be uncharacterized, even though they have completed their Initial Active Duty Training (IADT) successfully. A soldier being separated upon expiration of enlistment or fulfillment of service obligation will be awarded a character of service of honorable, unless the soldier is in entry level status and service is uncharacterized. In the case of an ARNGUS or USAR soldier on AD or ADT who is to be discharged, the character of the period of service from which he or she is discharged will be based solely on military behavior and performance of duty during the current period of service while he or she was actually performing AD or ADT. 3. AR 635-5 (Personnel Separations – Separation Documents) provides that Reserve component (RC) soldiers completing 90 days or more of continuous active duty for training (ADT), Full-Time National Guard Duty (FTNGD), active duty for special work (ADSW), temporary tours of active duty (TTAD), or Active Guard Reserve (AGR) service will be provided with a DD Form 214. RC soldiers completing initial ADT that results in the award of a military occupational specialty (MOS), even when the active duty period was less than 90 days will also be issued a DD Form 214 with a “Release from ADT or Release from ADT and Discharged from the Reserve of the Army and Return to the ARNG” Type of Separation. Their Character of Service will be annotated as “Uncharacterized”.
