IN THE CASE OF: BOARD DATE: 6 May 2021 DOCKET NUMBER: AR20190012721 APPLICANT REQUESTS: his training for Basic Sentry Dog Handler course is annotated on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Certificate of Training FACTS: 1. The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the ABCMR conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, he was not afforded the opportunity to present any training documents to be entered on his DD Form 214 at the time of his discharge. 3. The applicant provides a Department of the Army Certificate of Training, dated 22 November 1968, which reflects he successfully completed the Basic Sentry Dog Handler’s Course given at Fort Buckner, Okinawa. 4. A review of the applicant’s service record shows: a. He enlisted in the Regular Army on 29 August 1967. b. His DD Form 214 reflects he was honorable transferred to the U.S. Army Reserve on 28 August 1970, under the provisions of Army Regulation (AR) 635-200, Separation Program Number (SPN) 201, expiration of term of service. He served 3 years of net service this period. Item 25 (Education and Training Completed) of this form does not show he was awarded the Basic Sentry Dog Handler’s Course. 5. Army Regulation 635-5 (Personnel Separations – Separation Documents) prescribes the separation documents which are prepared for individuals upon retirement, discharge, or release from active military service or control of the Army BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief was warranted. The Board carefully considered the applicant's record of service, documents submitted in support of the petition and executed a comprehensive and standard review based on law, policy and regulation. Upon review of the applicant’s petition and available military records Board found evidence in the record that show the applicant completed the basic sentry dog handler’s course at Fort Buckner Okinawa on 22 November 1968. Based on this, the Board granted relief to correct the applicant’s DD form 214 to show his completed training. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending the applicant’s DD form 214 for the period ending 28 August 1970 in Item 25 (Education and Training Completed)- Basic Sentry Dog Handler’s Course. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the Army Board for Correction of Military Records (ABCMR) determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Personnel Separations – Separation Documents) prescribes the separation documents which are prepared for individuals upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for preparing and distributing DD Form 214 (Certificate of Release or Discharge from Active Duty). a. Paragraph 1-4a states, a DD form 214 will be prepared for all personnel at the time of their retirement, discharge, or release from Active Army. b.
