The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The Board will not consider the following portions of the applicant's requests, as these items will be addressed through an administrative correction: * award of the ARCOM and Iraq Campaign Medal with two bronze service stars * completion of the Basic Airborne Course in block 14 3. The applicant enlisted in the Regular Army on 5 March 2001. 4. He was honorably discharged on 18 June 2007. The DD Form 214 he received shows he was awarded or authorized the: * Army Good Conduct Medal * National Defense Service Medal * Global War on Terrorism Service Medal * Army Service Ribbon * Parachutist Badge * Driver and Mechanic Badge with "S" clasp 5. The applicant provides: a. Permanent Orders Number 284-027D, dated 11 October 2003, issued by Headquarters, 101st Airborne Division (Air Assault), Mosul, Iraq, which awarded him the ARCOM for duty in Iraq from 1 April to 4 September 2003. b. A Soldier Deployment History Outprocessing Report, dated 22 June 2007, that shows he was credited with 365 deployment days from 3 April 2003 to 2 April 2004, in a named operation at an unspecified location. 6. During the processing of this case, the Defense Finance and Accounting Service reviewed his Master Military Pay Account, which shows he served in Iraq from 3 April 2003 to 11 March 2004, a period of 11 months and 9 days. 7. Army Regulation 635-8 (Separation Processing and Documents) establishes the standardized policy for preparing and distributing the DD Form 214. Chapter 5 contains guidance on the preparation of the DD Form 214. It states, in effect, in block 18 for active duty Soldiers, list any/all OCONUS deployments completed during the period of the DD Form 214 being created adding the statement "Service in (Name of Country Deployed) From YYYYMMDD - YYYYMMDD)." BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found relief is warranted. 2. The Board found the evidence confirms the applicant served in Iraq and further found that the applicant's Master Military Pay Account provides the most accurate data of his period of service in Iraq. The Board determined his DD Form 214 should be corrected to reflect his deployment to Iraq from 3 April 2003 to 11 March 2004, a period of 11 months and 9 days. 3. The Board concurred with the corrections described in Administrative Note(s) below. ADMINISTRATIVE NOTE(S): The following orders and regulatory cites are sufficient to make the following administrative corrections to the applicant's DD Form 214 for the period ending on 18 June 2007, without action by the Board: * Permanent Order Number 284-027D, issued by HQs, 101st Airborne Division (Air Assault), on 11 October 2003, awarded him the ARCOM * Orders 235-1289, issued by HQs, U.S. Army Infantry Center, dated 23 August 2001, notes hazardous duty for parachute duty; Permanent Orders 234-397, issued by HQs, U.S. Army Infantry Center, dated 22 August 2001, awarded him the Parachutist Badge * Army Regulation 600-8-19 (Military Awards) paragraph 2-20 (Global War on Terrorism Expeditionary Medal (GWOTEM)) a. add to block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) the ARCOM and the Iraq Campaign Medal with two bronze service stars; and b. add to block 14 (Military Education) the entry: "Basic Airborne Course, 3 weeks, 2001." REFERENCES: 1. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-8 (Separation Processing and Documents) establishes the standardized policy for preparing and distributing the DD Form 214. Chapter 5 contains guidance on the preparation of the DD Form 214. It states, in effect, in block 18 for active duty Soldiers, list any/all OCONUS deployments completed during the period of the DD Form 214 being created adding the statement "Service in (Name of Country Deployed) From YYYYMMDD - YYYYMMDD)." 3. Army Regulation 600-8-22 (Military Awards) states the Iraq Campaign Medal is awarded to members who have served in direct support of Operation Iraqi Freedom (OIF). The area of eligibility encompasses all the land area of the country of Iraq, the contiguous water area out to 12 nautical miles, and all air spaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles. The Iraq Campaign Medal period of eligibility is on or after 19 March 2003 through 31 December 2011. A bronze service star is authorized for wear with this medal for participation in each credited campaign.
