IN THE CASE OF: BOARD DATE: 3 November 2020 DOCKET NUMBER: AR20200001477 APPLICANT REQUESTS: The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer of Discharge) to show his foreign service in the Republic of Vietnam (RVN). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he needs his records to show he served active duty in the RVN in 1963. It was top secret that the US Army was in Vietnam in 1963. He does not have orders or photographs to prove he was there. His DD Form 214 is incomplete and he asks it be corrected. His DD Form 214 needs to show he was in the RVN so he can be recognized as a wartime veteran. 3. The applicant was inducted into the US Army on 14 December 1961. 4. A review of the applicant's DA Form 20 (Enlisted Qualification Record) and DA Form 24 (Service Record) shows the applicant was assigned to Headquarters Battery, 4th Battalion, 3rd Artillery, 1st Armored Division, Fort Hood, Texas in 1963. There is no indication on either record that he served outside of the Continental United States during his enlistment. 5. The applicant's DD Form 214 shows he was inducted into the US Army on 14 December 1961 and was transferred to the US Army Reserve on 13 December 1963. He was awarded the Army Good Conduct Medal. He had served 2 years with no foreign service. He was released from the Army due to his expiration term of service. 6. A review of Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) did not show the applicant's unit participated in any RVN Campaign in 1963. 7. The applicant's service record did not contain evidence that he served in the RVN. BOARD DISCUSSION: The evidence presented does not demonstrate the existence of a probable error or injustice. The applicant’s official record is void of evidence that the applicant served in Vietnam or that he had foreign service. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. ?
