The applicant did not file within the three year time frame provided in Title 10, United States Code, section 1552(b); however, the ABCMR conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his DD Form 214 does not list the secondary MOS he received after completing qualifications for being a truck driver in Vietnam. He was a 5-ton truck driver in Vietnam, deployed with the 359th and 2nd Transportation Companies, 27th Transportation Battalion, in Qui Nhon, South Vietnam. He delivered supplies and chemicals throughout the central highlands from Qui Nhon to Pleiku, and beyond. He transported chemicals that have been proven harmful and as a result has illnesses related to them, such as cancer, diabetes, high blood pressure, and hearing loss. 3. A review of his military service records shows: a. On 15 December 1965, he was inducted into the Army of the United States. b. On 5 May 1966, he was deployed to the Republic of Vietnam for a period of 12 months. c. On 17 July 1967, he was awarded primary MOS 76T2O (Aircraft Repair Parts Specialist) and primary MOS 76H2O (Transportation Supply and Parts Specialist) was withdrawn c. On 22 September 1967, he was promoted to specialist five (E-5). Special Orders Number 208 issued by Headquarters Special Troops, US Army Armor Center, Fort Knox, KY on 22 September 1967 shows he was awarded the following MOS: (1) Primary (P): 76Y2O (Unit Supply Specialist) (2) Secondary (S): 76H2O (3) Additional (A): 64B2O (Heavy Vehicle Driver) and 76T2O (4) Withdrawn: P 76H2O S 64B2O d. His DA Form 20 (Enlisted Qualification Record) dated 5 December 1967 reflects: (1) In Item 8 (Duty MOS) ? 76T2O (2) In Item 22 (MOS) ? P 76H2O (P is crossed off) 15 April 1966, S 64B2O 9 November 1966, A 76T2O 17 July 1967, and P 76Q2O (Special Purpose Materiel Supply Specialist) 19 February 1968 (3) In Item 27 (Military Education) ? 76J2O (Transportation Supply and Parts Specialist) at US Army Transportation Corps and School, completed in 1966 (4) Item 31 states from 5 May 1966 through 4 May 1967, he served in U.S. Army Pacific (USARPAC) Vietnam (4) Item 38 (Record of Assignments) lists his assignments, as shown Effective Date Duty MOS Principle Duty Organization and Station or Theater 5 March 1966 76H2O Student 6th Student Company, Transportation Command, USATSCH, Fort Eustis, VA 7 May 1966 64B2O Heavy Vehicle Driver 2d Transportation Company, USARPAC 4 December 1966 64B2O Heavy Vehicle Driver 2d Trans Co, USARPAC 1 May 1967 -- Casual Enroute to CONUS 4. The applicant provides: a. DA Form 348 (Equipment Operator’s Qualification Record) issued on 4 June 1966, which shows the applicant qualified in the operation of truck equipment and successfully completed the required prerequisites. b. His record of vaccination lists all the immunizations he received during his period of service, although the reason for submission is unclear. c. A copy of his DD Form 214 for the period ending on 14 December 1967, which shows he was honorably released from active duty after completing 2 years of net service this period. (1) Item 23a (Specialty Number & Title) reflects his MOS as 76Y2O, General Supply & Parts Specialist (2) Item 25 (Education and Training Completed) states “N/A” 5. BOARD DISCUSSION: After reviewing the applicant's request, his statement, the supporting documents he provides, and his service record, the Board determined it would be appropriate in this case to amend the applicant's DD Form 214 by adding to item 25 the military training recorded in item 27 on his DA Form 20 and by adding to item 30 (Remarks) the MOS he requests. REFERENCES: 1. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3 year statute of limitations if the Army Board for Correction of Military Records (ABCMR) determines it would be in the interest of justice to do so. 2. Army Regulation (AR) 635-5 (Separation Documents) in effect at the time prescribes the separation documents that are furnished individuals who are retired, discharged, or released from active military service. The purpose of the separation is to provide the individual with documentary evidence of his military service. It is a vital record for interested Government agencies who assists the veterans in obtaining the rights and/or benefits to which he is entitled. It is important that information entered thereon be complete and accurate. a. Items 23a and b, enter primary MOS code number, title, and date of award. In addition, enter primary military occupational specialty (PMOS) evaluation score and date of score. If the enlisted person has not received a PMOS evaluation score, enter "None." If more space is required, enter "See 30" and continue remark in item 30. b. For Item 25, enter service schools, including major courses which were successfully completed, and military sponsored courses completed in civilian schools and colleges during period covered by the DD Form 214 being prepared. This entry includes the highest civilian education level acquired during this period of military service, if appropriate.
