APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DA Form 1380 (Record of Individual Performance of Reserve Duty Training), dated 10 September 2019 * Memorandum – Subject: DA Form 1380 Returned Without Action, dated 20 February 2020 FACTS: 1. The applicant states in part that his retirement points are incorrect as they do not reflect the service credit received for Inactive Duty Training (IDT) performed from 1-12 June 2018. 2. A review of the applicant's available service records reflects the following: a. After previously serving as an enlisted Soldier within the Army National Guard (ARNG) from 1984 - 2001, on 9 September 2002, the applicant was appointed as a Reserve commissioned officer and executed an oath of office. b. On 9 June 2005, the applicant received a Notification of Eligibility for Retired Pay at Age 60 (Twenty Year letter). c. On 9 December 2008, the U.S. Army Human Resources Command issued Orders reassigning the applicant as an Individual Mobilization Augmentee (IMA) effective 9 December 2008. d. For Retirement Year Ending (RYE) 2019 (4 May 2018 – 3 May 2019) the applicant was awarded a total of 330 Retirement Points (315 Active Duty points and 15 membership points). However, his records are void of service credit received during the month of June 2018. e. As of 11 August 2021, the applicant has accrued a total of 6,537 Retirement Points. 3. The applicant provides the following: a. DA Form 1380 reflective of the applicant completing online training (Distance Learning) associated with the Advanced Operations Course (Course 1-250-C3B) from 1-12 June 2018 totaling 96 hours. b. Memorandum – Subject: DA Form 1380 Returned Without Action, dated 19 February 2020, reflective of HRC, returning without action the applicant's request for service credit from 1-12 June 2018 due to the request being submitted later than the end of the duty month that the duty was performed. Further noted is the submitted DA Form 1380 is incorrect/not applicable to the time period of the duty. Effective 15 April 2016, approved Electronic Based Distributed Learning (EBDL) courses will be awarded to members of the Selected Reserve (SELRES) Troop Program Unit (TPU). Subject to available funding, and as pre-approved, Soldiers may earn one retirement point and be paid for one Inactive Duty Training (IDT) for every 8 hours of distance learning completed. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The Board also considered the HRC denial letter. The Board agreed the record could be corrected to show the DA Form 1380 was submitted timely; however, based upon a preponderance of the evidence, the Board determined the regulatory change in reference to awarding service credit for courses shows relief is not warranted. Army Regulation (AR) 140-185 (Training and Retirement Point Credits and Unit Level Strength Accounting Records) Chapter 2, Paragraph 2-14 (Criteria for Awarding Retirement Points) provides that personnel on active duty, Active Duty Training (ADT), Inactive Duty Training (IADT), involuntary ADT, or Annual Training (AT) are awarded one point for each calendar day they serve in one of these categories and may not be awarded additional points for other activities while in such status. A maximum of two retirement points may be credited for attendance at unit Battle Assemblies (BA) or IDT in any 1 calendar day. Approved electronic-based distributed learning (EBDL) courses will be awarded to members of the SELRES (TPU). Subject to available funding, and as pre-approved, Soldiers may earn one retirement point and be paid for one Inactive Duty Training (IDT) for every 8 hours of distance learning completed. a. Paragraph 3-3 (DA Form 1380) provides that the DA Form 1380 is utilized to record IDT performed by non-unit Soldiers under the jurisdiction of HRC who are attached for retirement points only to USAR TPUs, ARNG units, or to another service or component for training. Only attached Soldiers are authorized to perform IDT with the exception of one annual physical health assessment each for medical and dental readiness when authorized by the command prior to the event. Non-unit Soldiers attached for retirement point credit to IMA detachments are reported on DA Form 1379 (U.S. Army Reserve Components Unit Record of Reserve Training) for those units. b. Nonpaid DA Forms 1380 will not be entered into Automated Drill Attendance Reporting Software (ADARS) and will be forwarded to HRC for award of retirement points no later than the end of each duty month. c. With regard to awarding of retirement points for IDT (Four-Hour Rule), Service Members will be awarded one point for each 4-hour period of IDT duty performed. Maximum of two points per calendar day applies to IDT duty. Duty must be 8 hours in duration to receive two points per day. d. Paragraph 3-3b, provides that a DA Form 1380 will be prepared for a unit Soldier who performs equivalent training or additional training. The code "P" or "N" will be entered in item 10c before the retirement point credit. The code "P" indicates the Soldier is entitled to inactive duty pay for the duties performed; the code "N" indicates the Soldier is entitled to retirement point credit only. 2. Department of Defense Instructions 1215.07 (Service Credit for Non-Regular Retirement) states inactive duty may be credited for each attendance at an inactive duty training period.
