IN THE CASE OF: BOARD DATE: 5 October 2020 DOCKET NUMBER: AR20200002052 APPLICANT REQUESTS: in effect, correction of his record to show his scheduled Health Professions Loan Repayment Program (HPLRP) payment began in October 2019 instead of February 2020. The applicant states he was sworn into the Army National Guard (ARNG) on 18 October 2018 as a dentist. He was recruited under the loan reimbursement program. He is currently not scheduled to receive his loan repayment until February 2020. He should receive his annual repayment in the same month as his swear in date. The reason the payment is delayed is due to the ARNG Guard Incentive Management System being inoperable from October 2018 until February 2018 [sic]. The date for his loan repayment was set at the date the system came back online. The 4-month system outage did not relieve him of his duties or relieve him for interest collected on his loans. He feels the contract should be back dated to reflect the date he was sworn into the Army Guard and the agreed upon contractual agreement between himself and the Army. 2. A review of the applicant's official records shows the following: a. On 14 May 2004, the Doctor of Dental Surgery degree was conferred upon the applicant. b. On 18 October 2018, the applicant was appointed as a Reserve commissioned officer and executed an oath of office. c. The applicant's records are void of a HPLRP contract or any addendums pertaining to the HPLRP. 3. The applicant provides: a. NGB Form 337 showing he was appointed as a Reserve commissioned officer on 18 October 2018. b. Orders Number 332-016, issued by the Florida ARNG, Office of the Adjutant General, which appointed the applicant in the ARNG as a general dentist. c. HPLRP statement of understanding showing the applicant increased his HPLRP aggregate amount to $40,000.00 per year on 28 February 2019. d. DA Form 5536 showing the applicant would be performing duties as a general dentist, and the anniversary date would be determined based upon the date the agreement was signed. 4. See applicable references below. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found that relief is not warranted. 2. The Board noted there is no evidence confirming the applicant's claim that completion of his HPLRP agreement was delayed by a system outage. In the absence of such evidence, the Board determined the effective date of his agreement is not in error or unjust. Army Regulation 621-202 (Army Educational Incentives and Entitlements), chapter 8 (Selected Reserve HPLRP) states this chapter provides policy and guidance for the administration of the HPLRP. Under Title 10, United States Code, section 16302, the program is designed to repay designated loans secured by eligible health professions officers serving in Selected Reserve with wartime critical medical skill shortages. a. Paragraph 8-3 states repayment of loans is made on the basis of each year of satisfactory service performed by a health professional as a qualified commissioned officer in the Selected Reserve. For each year of satisfactory service as a Selected Reserve member, the Government will repay designated loans for an officer who: * is participating satisfactorily as a Selected Reserve member * initiates DA Form 5536 (Agreement HPLRP) b. Paragraph 8-4 states to apply for participation in the HPLRP, the eligible officer must have qualifying loans at the time of signing the DA Form 5536. Selected Reserve unit members will process through their AMEDD recruiter. The anniversary date for repayment of the loan is based on the date the officer completes the agreement. Each year of satisfactory Selected Reserve service performed under the terms of the agreement will qualify the Service member for repayment of eligible loans. 2.
