The applicant did not file within the three year time frame provided in Title 10, United States Code, section 1552(b); however, the ABCMR conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he attended a two week NBC training class at Fort Huachuca, AZ in 1984 in which he expected to receive an ASI for. He also attended an Air Loader training class in the same year and location. He deployed to San Pedro Sula, Honduras, Central America in December of 1984 in direct support of a Military Airlift Command mission as an air loader. He did not get credit for any of this training or this deployment. He requests the KDSM be added so that it reflects his service. If he had received credit for the above mentioned training, he could considered for additional promotion points and possible promotion. His deployment in support of Big Pine II was omitted from his DD Form 214. He believes that exposure and premedical deployment preparedness could have caused medical issues that he deal with today. Without it being listed on his DD Form 214 there is no link to his service to Honduras Central America. 3. The applicant's records contain sufficient evidence to support additional awards not shown on his DD Form 214 also additional military education. His DD Form 214 for the period ending 3 August 1985 will be administratively corrected without Board action to show: * Block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized): Korea Defense Service Medal * Block 14 (Military Education): Nuclear, Biological, Chemical Defense Course 2 weeks (1983) 4. The Board will consider the applicant's request for correction of his DD Form 214 to add: * Additional Skill Identifier (ASI) for the NBC Defense Course * Air Loader Course * Foreign Service Credit for deployment to San Pedro Sula, Honduras 5. The applicant provides: * NBC Defense Course Certificate showing he completed the course from 7 November to 18 November 1983 also showing ASI of 3R * Shot record cover showing a positive TB (tuberculosis) skin test (do not repeat) * Personal Health History showing immunizations received from 10 August 1981 thru 5 December 1984 * Souvenir receipt showing four items purchased from Hotel Copantl Sula in San Pedro Sula, Honduras, Central America * Hotel writing pad showing it came from Hotel and Club Copantl in San Pedro Sula, Honduras, Central America 6. A review of the applicant’s service records shows: a. He enlisted in the Regular Army on 21 February 1981. He held military occupational specialty 31J (Teletypewriter Repairer). b. His DA Form 2-1 (Personnel Qualification Record) shows in part 5 (Oversea Service) that he served in Korea from 26 May 1982 until 25 May 1983. Part 17 (Civilian Education and Military Schools) shows NBC Course (2 weeks) 83 however; does not show Air Loader Course and the applicant did not provide evidence of course completion. c. He attended and successfully completed the NBC Defense Officer/NCO Course from 7 November–18 November 1983. d. There is no evidence in the service record nor did the applicant provide any substantial evidence that he was deployed to San Pedro Sula, Honduras for a specified duration. e. On 3 August 1985, he was honorably released from active duty and transferred to the US Army Reserve Control Group due to expiration term of service. His DD Form 214 shows: * Item 11: (Primary Specialty Number, Title, and Years and Months in Specialty) 31J Teletypewriter Repairer 3 years 1 month * Item 12f: (Foreign Service) 1 year, 0 months, 0 days * Item 13: (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized): Army Service Ribbon; Overseas Service Ribbon; Good Conduct Medal; Expert Badge (Rifle M-16) * Item 14 (Military Education): 31J Teletypewriter Repairer 20 weeks (82); Battalion Training Management System 1 week (83); Maintenance Management System Course 1 week (84) BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined partial relief was warranted. Based upon the available documentation, the Board made the following findings and recommendations: * NBC Defense Officer/Non-Commissioned Officer Course – GRANT, based upon the Certificate of Training found within the applicant’s record * Additional Skill Identifier (ASI) for the NBC Defense Course – DENY, based upon Department of the Army Pamphlet 611-21 (Military Occupational Classification and Structure) in effect currently, does not contain an ASI for the NBC Course * Air Loader Course to his DD Form 214 – DENY, based upon a lack of evidence showing any course within the applicant’s record * Foreign Service Credit for deployment to San Pedro Sula, Honduras – DENY, based upon insufficient evidence of any foreign service credit within Honduras; there was some evidence, but that evidence failed to show the amount of time spent and in what military status * Korean Defense Service Medal (KDSM) – GRANT, based upon the information reflected on the applicant’s DA Form 2-1 BOARD VOTE: Mbr 1 Mbr 2 Mbr 3 : : : GRANT FULL RELIEF :XXX :XXX :XX GRANT PARTIAL RELIEF : : : GRANT FORMAL HEARING : : : DENY APPLICATION BOARD DETERMINATION/RECOMMENDATION: 1. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 by * (Item 13) awarding and adding the Korean Defense Service Medal * (Item 14) adding NBC Defense Course 2 weeks (83) 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to all other sought relief. I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3 year statute of limitations if the Army Board for Correction of Military Records (ABCMR) determines it would be in the interest of justice to do so. 2. Army Regulation (AR) 600-8-22(Military Awards), the Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who have served on active duty in support of the defense of the Republic of Korea. The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense. 3. AR 635-5 (Separation Documents), provides detailed instructions for completing separation documents, including the DD Form 214. It provides, in pertinent part, for: a. Item 11 (Primary Specialty) From the Enlisted Record Brief, enter the titles of all MOS served for at least 1 year and include for each MOS the number of years and months served. For time determination, 16 days or more count as a month. For an enlisted Soldier, also specify the first 5 characters of the primary MOS code (MOSC), which includes the 3 characters of the MOS, the fourth character of skill and grade level in the MOS, and the fifth character of a special qualification identifier (SQI), if applicable. Enter "0" when not applicable. b. Item 12f: (Foreign Service) From the ERB/ORB, enter the total amount of foreign service completed during the period covered in block 12c. c. Item 14 (Military Education) From ERB/ORB, list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214. 4.
