The applicant states he no longer has student loans and had been working with in incentives for nearly two years to get it resolved. 2. A review of the applicant's official records shows the following: a. On 17 September 2013, U.S. Army Recruiting Command Form 1252 (U.S. Army Reserve (USAR) and Army National Guard Incentives Declaration Statement) was completed showing the applicant selected the HPLRP (number one option) and the 3-year special pay (number two option) upon accession into the USAR. In conjunction with this document the HPLRP contract was completed showing: * he was commissioning into the Dental Corps in area of concentration 63A (General Dentist) with the HPLRP and special pay incentive * he would incur a statutory 8-year service obligation which would commence on the effective date of appointment * he understood a maximum aggregate of $40,000.00 per year for the first six years and $10,000.00 for the seventh year not to exceed $250,000.00 would be paid towards student loans b. On 2 May 2014, the applicant was appointed as a Reserve commissioned officer in the Dental Corps and executed an oath of office. c. On 2 July 2014, DA Form 5074 (Record of Award of Entry Grade Credit (Medical and Dental Officers) shows the applicant graduated from the University of Colorado with a Doctorate in Dental Surgery on 28 May 2010. d. The applicant remains in the USAR. 3. The applicant provides a Nelnet balance sheet showing a zero balance for all loans. 4. See applicable references below. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was not warranted. Based upon the applicant’s entry into military service showing he executed a HPLRP and special pay incentive as part of his enlistment, the Board concluded there was insufficient evidence of an error or injustice which would warrant a change to the applicant’s record. Title 37, United States Code, section 332 states the Secretary concerned may pay a bonus under this section to a person, including an officer in the uniformed services, who accepts a commission or appointment as an officer in a uniformed service or affiliates with a Reserve Component of a uniformed service. A bonus under this section may be paid in a lump sum or in periodic installments, as determined by the Secretary concerned. To receive a bonus under this section, a person or officer determined to be eligible for the bonus shall enter into a written agreement with the Secretary concerned that specifies the amount of the bonus; the method of payment of the bonus under subsection (c)(2); the period of obligated service; and the type or conditions of the service. 2. Memorandum, Subject: Health Professions Officer Special and Incentive Pay Plan, dated 29 September 2017, effective on 1 October 2017, states a fully qualified general dentist is entitled to the following retention bonuses: * 2-year retention bonus (paid annually) $13,000.00 * 3-year retention bonus (paid annually) $19,00.00 * 4-year retention bonus (paid annually) $25,000.00 The member must be a graduate of an American Dental Association-accredited school of dentistry and possess a Doctor of Dental Surgery or Doctor of Dental Medicine degree. 3. Army Regulation 15-185 (Army Board for Correction of Military Records (ABCMR)) prescribes the policies and procedures for correction of military records by the Secretary of the Army, acting through the ABCMR. The ABCMR may, in its discretion, hold a hearing or request additional evidence or opinions. Additionally, it states in paragraph 2-11 that applicants do not have a right to a hearing before the ABCMR.
