The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his DD Form 214 does not show his service in Bosnia, possibly due to an administrative oversight. 3. Review of the applicant's service records shows: a. He enlisted in the Regular Army on 9 September 1980 and held a maintenance military occupational specialty. b. He served through multiple reenlistments, in a variety of stateside or overseas assignments, and he attained the rank/grade of first sergeant (1SG). c. His DA Form 2-1 (Personnel Qualification Record) shows he served in: * Germany, 20 October 1982 to 29 August 1984 * Hawaii, 2 October 184 to 1 October 1988 * Germany, 25 January 1993 to 24 January 1997 (Bosnia 29 December 1995 to 24 November 1996) d. He was honorably retired on 30 September 2000. His DD Form 214 shows in: * Block 2f (Foreign Service) 9 years, 10 months, and 9 days * Block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), among other awards the Armed Forces Expeditionary Medal, Armed Forces Service Medal, and NATO Medal * Block 18 (Remarks) does not list his deployment to Bosnia 4. He provides: a. Order 95-425, issued by Headquarters, 1st Armored Division, Germany ordering deployment of Soldiers to Bosnia in support of Operation Joint Endeavor, effective 16 December 1995. A list of names is provided, with the applicant's name indicated on that list, deploying on 29 December 1995. b. Leave and Earnings Statements for the months of July, August, September, and October 1996, showing receipt of hostile fire pay. c. Chronological Record of Medical Care, in theater, dated 21 November 1996, that listed his deployment dates to Bosnia as 2 January 1996 to 23 November 1996. 3. By regulation (AR 635-5), Item 18, for an active duty Soldier deployed with his or her unit during their continuous period of active service, the statement "SERVICE IN (Name of Country Deployed) FROM (inclusive dates for example, YYYYMMDD-YYYMMDD)" is entered in item 18. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was warranted. The Board carefully considered the applicants request, supporting documents, evidence in the records and regulatory guidance. The Board considered the applicant’s statement, his military service record and documents provided by the applicant. Evidence in the record show the applicant deployed to Bosnia in support of Operation Joint Endeavor from 29 December 1995 to 24 November 1996. Therefore, relief was granted to correct the applicant’s record to show his service in Bosnia. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 ending on 30 September 2000 by adding to item 18 (Remarks) Bosnia 29 December 1995 to 24 November 1996. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The DD Form 214 provides the individual with documentary evidence of his or her military service. Chapter 2 contains guidance on the preparation of the DD Form 214.
