APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Memorandum, Subject: Applicant Points Only FY 2020 * DA Forms 1380 (Record of Individual Performance of Reserve Duty Training), dated, 24 February 2020, 6 February 2020, 31 March 2020, 29 April 2020, 28 May 2020, 1 July 2020, 29 July 2020, and 7 August 2020 FACTS: 1. The applicant states in effect approval of retirement points for FY 2020. 2. A review of the applicant's official records shows the following: a. On 15 November 2012, having had prior enlisted service in the Army National Guard (ARNG), the applicant was appointed as a Reserve commissioned officer in the ARNG and executed an oath of office. b. On 1 July 2014, the applicant was honorably released from the ARNG and transferred to the U.S. Army Reserve (USAR) Control Group (Individual Ready Reserve). He completed 1 year, 7 months, and 17 days of net service, with 3 years and 9 days of prior Reserve Component service, and 8 months and 9 days of prior active federal service. c. On 4 December 2014, Orders Number C-12-416594, issued by the U.S. Army Human Resources Command (HRC), reassigned the applicant from the USAR Control Group (Reinforcement) and reassigned him to B Company, 436th Civil Affairs Battalion. d. DA Form 5016 (Chronological Statement of Retirement Points) shows for the period beginning on 27 February 2019 and ending on 26 February 2020 the applicant was awarded 58 Inactive Duty (IDT) points and 15 membership points. 3. The applicant provides: a. Memorandum, Subject: Applicant Points Only FY 2020 wherein a unit representative completed the memorandum stating the applicant performed duties as the A Company, 436th Civil Affairs Battalion, Commander for points only during FY 2020. The unit representative was unaware of the points only process due to being untrained. b. DA Forms 1380 showing the following: * 13, 17, 20, 24, 27 and 31 January 2020, 4 hours each day, "P1", commander tasks. * 3, 7, 10, 14, 17, 19, 24, 25 February 2020, 4 hours each day "P1", commander tasks * 3, 5, 10, 17, 24 and 31 March 2020, 4 hours each day, "P1", administrative tasks. * 7, 14, 21, 23, 28 April 2020, 4 hours each day, "P1", administrative tasks. * 5, 12, 14, 19, and 26 May 2020, 4 hours each day, "P1", administrative tasks and preparation for May battle assembly. * 2, 4, 9, 16, 23 and 30 June 2020, 4 hours each day, "P1", administrative tasks and preparation for June battle assembly. * 7, 9, 14, 19, 20, 21 and 28 July 2020, 4 hours each day, "P1", administrative tasks and virtual annual training. * 4 and 6 August 2020, 4 hours each day, "P1", training plans and preparation for FY 2020 annual training. 4. On 20 May 2021, in the processing of this case an advisory opinion was obtained from HRC, Chief, Personnel Actions Branch, which stated, the applicant's DA Forms 1380 covering the periods January 2020 through August 2020 are in violation of Army Regulation (AR) 140-185 (Training and Retirement Point Credits and Unit Level Strength Accounting Records), paragraph 3-3b., which requires that nonpaid or retirement "points only" DA Forms 1380 be forwarded to HRC no later than the end of each duty month. All the DA Forms 1380 in this request were authenticated on 30 October 2020. In addition to non-compliance with the regulation, the DA Forms 1380 were completed for pay (code P1 in block 9c) instead of for points only (code N1 in block 9c). 5. On 25 May 2021, the advisory opinion was provided to the applicant to provide a response. As of 29 September 2021, the applicant had not responded. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief was warranted. Regulatory guidance requires nonpaid or retirement "points only" DA Forms 1380 be forwarded to HRC no later than the end of each duty month. In this case, the DA Forms 1380 were authenticated on 30 October 2020, and were also completed for pay. The Board found that, due to administrative errors (timeliness and improper coding), the applicant was deprived of retirement points for duties that he performed. The Board determined that, as a matter of equity, the applicant’s record should be corrected by adding the missing points to his chronological statement of retirement points. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing he completed nonpaid DA Forms 1380, showing rule 10, Code "N1," and they were forwarded to HRC in a timely manner meeting submission timelines for consideration. HRC will determine the appropriate amount of credit as a result of this correction. REFERENCE: AR 140-185 (Training and Retirement Point Credits and Unit Level Strength Accounting Records) Chapter 2, Paragraph 2-14 (Criteria for Awarding Retirement Points) provides that personnel on active duty, Active Duty Training (ADT), Inactive Duty Training (IADT), involuntary ADT, or Annual Training (AT) are awarded one point for each calendar day they serve in one of these categories and may not be awarded additional points for other activities while in such status. A maximum of two retirement points may be credited for attendance at unit Battle Assemblies (BA) or IDT in any 1 calendar day. a. Paragraph 3-3 (DA Form 1380) provides that the DA Form 1380 is utilized to record IDT performed by non-unit Soldiers under the jurisdiction of HRC who are attached for retirement points only to USAR TPUs, ARNG units, or to another service or component for training. Only attached Soldiers are authorized to perform IDT with the exception of one annual physical health assessment each for medical and dental readiness when authorized by the command prior to the event. Non-unit Soldiers attached for retirement point credit to IMA detachments are reported on DA Form 1379 (U.S. Army Reserve Components Unit Record of Reserve Training) for those units. b. Nonpaid DA Forms 1380 will not be entered into Automated Drill Attendance Reporting Software (ADARS) and will be forwarded to HRC for award of retirement points no later than the end of each duty month. c. Paragraph 3-3b, provides that a DA Form 1380 will be prepared for a unit Soldier who performs equivalent training or additional training. The code "P" or "N" will be entered in item 10c before the retirement point credit.
