ABCMR Letter to Applicant, 25 November 2019 FACTS: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the ABCMR in Docket Number AR20180011506 on 29 July 2019. 2. In his letter to the VA, 15 July 2013, he states his records are not correct. His DD Form 214 shows he served in logistical supply while he was in Vietnam. He never served in logistical supply; he served as a mechanic, repairing tanks and personnel carriers. He attached photographs of the area where he worked and was injured. 3. He enlisted in the Regular Army on 10 August 1967. 4. His DA Form 20 (Enlisted Personnel Qualification Record) shows he completed the general supply course and was awarded MOS 76A (Supply Clerk) effective 24 November 1967. a. Item 31 (Foreign Service) shows he received credit for foreign service in U.S. Army Pacific-Republic of Vietnam from 2 October 1968 through 24 August 1969. b. Item 38 (Record of Assignments) shows he served as a supply man in MOS 76A assigned to Company D, 709th Maintenance Battalion, effective 11 October 1968. 5. Headquarters, 9th Infantry Division, Special Orders Number 59, 28 February 1969, promoted him to the rank/grade of specialist five/E-5. His MOS is shown as 76Y (Unit and Organization Supply Specialist). 6. He was honorably released from active duty on 7 August 1970. Item 23a (Specialty Number and Title) of his DD Form 214 shows his MOS as 76Y (Unit and Organization Supply Specialist). 7. The letter from the VA, 1 March 2019, certified he is receiving service-connected disability compensation. 8. On 29 July 2019, the ABCMR denied his request to change the MOS shown on his DD Form 214. The Board determined the evidence of record shows he received published MOS orders showing the MOS listed on his DD Form 214. The Board agreed regulatory guidance provides for listing the primary MOS on the separation document. BOARD DISCUSSION: After reviewing the application and all supporting documentation, the Board found that relief was not warranted. The Board carefully considered the applicant’s request, supporting documents, evidence in the records and noted that the applicant’s submission is for reconsideration of a previous case. After the review, the Board found no new evidence in support of his request; the Board did not find evidence that the applicant was awarded the requested MOS. Based on a preponderance of evidence, the Board determined that the MOS as reflected on the DD Form 214 was not in error or unjust and therefore, there is no basis upon which to grant his request. Army Regulation 15-185 (Army Board for Correction of Military Records) prescribes the policies and procedures for correction of military records by the Secretary of the Army acting through the ABCMR. The ABCMR begins its consideration of each case with the presumption of administrative regularity. The applicant has the burden of proving an error or injustice by a preponderance of the evidence. 2. Army Regulation 635-5 (Separation Documents), 23 January 1967, prescribed the separation documents that must be prepared for Soldiers upon retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214. The general instructions stated all available records would be used as a basis for preparation of the DD Form 214.
