The applicant did not file within the three-year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to file in a timely manner. 2. The applicant states: a. He was assigned to Headquarters Company (U.S.), Allied Command Europe Mobile Force (Land), Mannheim, Germany. He served in support of Operation Joint Endeavor in Bosnia from approximately December 1995 to February 1996. His IFOR security badge was issued in Bosnia. His spouse served with him at Coleman Barracks, Germany. b. The Armed Forces Expeditionary Medal and Armed Forces Service Medal were authorized for wear in 1997, which was after his discharge. The issuance of these awards would substantiate his Department of Veterans Affairs (VA) compensation claim to prove his service in Bosnia and give him priority for federal hiring. 3. The applicant's service record shows: a. On 28 March 1991, the applicant enlisted in the Regular Army. b. DA Form 2-1 (Personnel Qualification Record) shows in: (1) Item 5 (Oversea Service) – service in Germany from 11 January 1994 to 10 January 1996. (2) Item 9 (Awards, Decorations and Campaigns) – * Army Service Ribbon * National Defense Service Medal * Air Assault Badge * Noncommissioned Officer Professional Development Ribbon * Army Achievement Medal c. On 31 March 1996, he was honorably released from active duty. His DD Form 214 shows in Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) – * Air Assault Badge * Army Achievement Medal * National Defense Service Medal * Noncommissioned Officer Professional Development Ribbon * Army Service Ribbon * Sharpshooter Marksmanship Qualification Badge with Rifle Bar (M-16) * Sharpshooter Marksmanship Qualification Badge with Grenade Bar 4. The applicant provides: a. Statement of D___, dated 11 June 2020, in which she states that the applicant, her husband, was deployed to Bosnia while they were stationed at Coleman Barracks in Mannheim, Germany. She was assigned to the 95th Military Police Jail. He was assigned to the North Atlantic Treaty Organization, Allied Command Europe Mobile Force (Land). The Armed Forces Expeditionary Medal and Armed Forces Service Medal would entitle him to benefits for service in a hostile area. b. IFOR security badge, expiration date 2012. ? BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief was not warranted. The applicant’s contention, service record, and regulatory guidance were carefully considered. Based on the documentation available for review, the Board found insufficient evidence for the award of the Armed Forces Expeditionary Medal or the Armed Forces Service Medal. Although the applicant served in Germany during the qualifying period, documentation does not support that he met regulatory requirements for award. Specifically, documentation, to include the applicant’s DD Form 214, is void of deployment orders to Bosnia-Herzegovina for either Operations Joint Endeavor or Joint Guard. ADMINISTRATIVE NOTE(S): A review of the applicant’s records shows he is authorized an award not annotated on his DD Form 214. Signed Permanent Order 36-103 dated 24 August 94 awards him the Army Good Conduct Medal for the period 28 March 1991 to 27 March 1994 and his DD Form 214 for the period ending 31 March 1996 will be administratively corrected. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) provides Army policy, criteria, and administrative instructions concerning individual and unit military awards. a. The Armed Forces Expeditionary Medal is awarded for qualifying service after 1 July 1958 in U.S. military operations, U.S. operations in direct support of the United Nations, and U.S. operations of assistance for friendly foreign nations. Qualifying service for this award includes participation in Operation Joint Endeavor in support of the Former Republic of Yugoslavia in Bosnia-Herzegovina from 20 November 1995 to 19 December 1996 b. The Armed Forces Service Medal may be awarded to members of the Armed Forces of the United States for operations for which no other U.S. campaign or service medal is approved and who, after 1 June 1992 participate or have participated as members of U.S. military units in a U.S. military operation deemed to be a significant activity and encounter no foreign armed opposition or imminent threat of hostile action. Service members must be bona fide members of a unit participating in or engaged in direct support of the operation for 30 consecutive days in the area of eligibility (or for the full period when an operation is of less than 30 days' duration) or 60 nonconsecutive days provided this support involves entering the area of eligibility or meet the following criteria: (1) While participating as a regularly assigned aircrew member, accumulates 15 days service (consecutive/nonconsecutive flying sorties into, out of, within, or over the area in direct support of the military operations. (2) One day's service is credited for the first sortie flown on any day. Additional sorties flown on the same day receive no further credit 3. Military Personnel Message Number 99-100 authorized award of both the Armed Forces Service Medal and the Armed Forces Expeditionary Medal, as a one-time exception to Department of Defense and Service policy, for qualifying service in support of Operations Joint Endeavor and Joint Guard in the Republic of Bosnia-Herzegovina. This exception allowed both service medals to be presented to personnel deployed in Bosnia-Herzegovina during the periods 1 June 1992 to 19 December 1996 (Operation Joint Endeavor) and 20 December 1996 to 20 June 1998 (Operation Joint Guard).
