APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214, ending on 25 February 2020 FACTS: 1. The applicant states that his DD Form 214 is incorrect. He was promoted to SPC prior to his discharge from active duty. 2. The applicant's service record shows: a. On 25 October 2016, the applicant enlisted in the Regular Army. b. DA Form 199 (Informal Physical Evaluation Board (PEB) Proceedings), dated 15 November 2019, shows the applicant was on active duty status as a PFC when the PEB convened. c. Orders Number 352-0010 issued by Headquarters, 3rd Infantry Division and Fort Stewart, dated 18 December 2019, shows the applicant was reassigned to the Fort Stewart, GA, Transition Center with a reporting date of 25 February 2020. His rank was PFC. d. Orders Number ST-008-0872 issued by Headquarters, 3rd Infantry Division and Fort Stewart, dated 8 January 2020, shows the applicant was deployed to Drawsko Pomorskie, Poland in support of the European Deterrence Initiative on or about 17 February 2020. His rank was PFC. e. Orders Number ST-008-0872 (N) issued by Headquarters, 3rd Infantry Division and Fort Stewart, dated 8 January 2020, shows the applicant was on North Atlantic Treaty Organization Travel Orders from 17 February 2020 through 17 July 2020. His rank was PFC. f. Orders Number ST-008-0872 (R) issued by Headquarters, 3rd Infantry Division and Fort Stewart, dated 13 January 2020, revoked Orders Number ST-008-0872, dated 8 January 2020. The applicant's rank was PFC. g. The applicant's available records are void of a DA Form 4187 (Personnel Action) promoting him to the rank of SPC. His records are also void of his Enlisted Record Brief, which captures a Soldier's classification, appointments and reductions, assignment data, oversea service, family data, and training and is constantly updated over the course of the Soldier's career. Likewise, it is void of any derogatory information. 3. The applicant provides a DD Form 214, ending on 25 February 2020, showing the applicant was honorably released from active duty due to a non-combat related disability with severance pay. (1) Block 4a (Grade, Rate, Rank) – PFC. (2) Block 4b (Pay Grade) – E-3. (3) Block 12c (Net Active Service This Period) – 3 years, 4 months, and 1 day. (4) Block 12i (Effective Date of Pay Grade) – 1 September 2017. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The Board determined there is insufficient evidence that shows he was a SPC at the time the DD Form 214 was completed. ? Army Regulation (AR) 15-185 (Army Board for Correction of Military Records (ABCMR) prescribes the policies and procedures for correction of military records by the Secretary of the Army acting through the ABCMR. The ABCMR begins its consideration of each case with the presumption of administrative regularity. The applicant has the burden of proving an error or injustice by a preponderance of the evidence. 2. AR 635-8 (Separation Processing and Documents) provides the separation documents which are prepared for individuals upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparing and distributing the DD Form 214. Chapter 2 contains the specific instructions for the preparation of the DD Form 214. These instructions stated for Item 4a (Grade, Rate or Rank) and Item 4b (Pay Grade) to enter the active duty grade and pay grade at the time of separation, respectively. 3.
