The applicant enlisted in the Regular Army on 30 January 2009. He completed training and was awarded military occupational specialty 13F (Fire Support Specialist). 2. His records contain an ERB dated 29 February 2012, which shows his record flagged for weight control effective 19 May 2011. 3. He served in Afghanistan from 22 August 2010 to 11 August 2011. He was honorably released from active duty on 3 June 2012, in the rank of specialist. He completed 3 years, 4 months, and 4 days of active service. The DD Form 214 he was issued shows he was awarded or authorized the: * Army Commendation Medal * National Defense Service Medal * Afghanistan Campaign Medal with 2 campaign stars * Global War on Terrorism Service Medal * Army Service Ribbon * Overseas Service Ribbon * North Atlantic Treaty Organization Medal 4. There is no evidence in the available records that shows he was awarded the AGCM; neither is there evidence of a commander's disqualification for the award. Additionally, there is no evidence of any convictions by courts-martial or receipt of nonjudicial punishment under Article 15, Uniform Code of Military Justice. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief was warranted. Board members noted that although his ERB dated 29 February 2012, shows his record flagged for weight control effective 19 May 2011, this does not exclude him from the award. There is no evidence in the available records that shows he was awarded the AGCM; neither is there evidence of a commander's disqualification for the award. Additionally, there is no evidence of any convictions by courts-martial or receipt of nonjudicial punishment under Article 15, Uniform Code of Military Justice. Board members voted to grant relief. REFERENCES: Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. The AGCM is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of active Federal military service. Although there is no automatic entitlement to the AGCM, disqualification must be justified. Suspension of favorable personnel action does not automatically terminate the eligibility period. The reason for suspension must be considered by the unit commander (for example an adverse action flag may disqualify the eligibility period whereas, a flag for weight control program that results in a Soldier achieving Army standards, typically does not result in disqualification).
