IN THE CASE OF: BOARD DATE: 23 July 2021 DOCKET NUMBER: AR20210007244 APPLICANT REQUESTS: Correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show military occupational specialty (MOS) 13F (Fire Support Specialist). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Enlisted Record Brief * DD Form 214 FACTS: 1. The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he believes officials forgot to add this MOS. 3. Review of the applicant's service records shows: a. He enlisted in the Regular Army on 11 April 2007. His DD Form 1966 (Record of Military Processing) shows he enlisted for training in MOS 13F, for 3 years and 17 weeks. b. His Enlisted Record Brief (ERB) shows he was assigned to Fort Sill, OK for training. It also shows, he was assigned to Fort Carson, CO in duty MOS 13F, from August 2007 to January 2010. However, there is no indication in his records that he completed training in or awarded MOS 13F. * There are no orders awarding him the MOS * There are no certificates of completion or diplomas * His ERB does not list this MOS having been completed or awarded c. He served in Iraq from 5 September 2008 to 18 August 2009. d. On 9 February 2010, he executed a 3-year reenlistment in the Regular Army. He reenlisted for training in MOS 91H, Track Vehicle Repairer. e. Around February 2010, he completed 12 weeks of training in MOS 91H (Track Vehicle Repairer) at Aberdeen Proving Ground, MD. f. He served in Afghanistan from 14 June 2011 to 3 November 2011. g. He was honorably released from active duty on 8 May 2014. His DD Form 214 shows he completed 7 years and 28 days of active service. It also shows in: * Block 11 (Primary Specialty) 91H, Track Vehicle Repairer, 5 years and 9 months * Block 14 (Military Education), 91H, Track Vehicle Repairer Course, 12 weeks, 2010 4. By regulation (AR 635-8), in Block 11 of the DD Form 214, enter the titles of all MOSs awarded and held for at least 1 year during the current period of service and include for each MOS the number of years and months held. For an enlisted Soldier, specify the first five characters of the military occupational specialty code which includes three characters of the MOS, the fourth character of skill and grade level in the MOS, and the fifth character of a special qualification identifier, if applicable. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was warranted. Based upon the information reflected on the applicant’s ERB and the information showing the applicant reenlisted for 91H training, under assignment history, the Board concluded there was sufficient evidence to show the applicant completed 13F training and was awarded the MOS. As a result, the Board recommended adding the 13F MOS to his DD Form 214. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 by adding the following to Primary Specialty (Item 11): * REMOVING: 91H1O, TRACK VEHICLE REPAIRER – 5 YRS, 9 MOS * ADDING 13F1O FIRE SUPPORT SPECIALIST – 3 YRS, 9 MOS * ADDING 91H1O TRACK VEHICLE REPAIRER – 3 YRS, 1 MO I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3 year statute of limitations if the Army Board for Correction of Military Records (ABCMR) determines it would be in the interest of justice to do so. 2. Army Regulation 635-8 (Separation Processing and Documents) prescribes the separation documents that must be prepared for Soldiers upon retirement, discharge, or release from active duty service or control of the Active Army. It establishes standardized policy for preparing and distributing the DD Form 214. The DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. a. Block 11: Primary Specialty. Enter the titles of all MOSs or areas of concentration (AOCs) awarded and held for at least 1 year during the current period of service and include for each MOS/AOC the number of years and months held. For time determinations, 16 or more days counts as a month. Do not count time in training (basic training, advanced individual training, Basic Officer’s Leader Course, or MOS-producing school). Primary specialty MOS or AOC is awarded by Service school completion or by publication of orders awarding the MOS or AOC. b. For an enlisted Soldier, specify the first five characters of the military occupational specialty code (MOSC), which includes three characters of the MOS, the fourth character of skill and grade level in the MOS, and the fifth character of a special qualification identifier, if applicable. Enter “O” when not applicable. When MOSCs merge at skill level 5, or convert to another MOSC, make separate entries for the highest skill level in each MOSC held for at least 1 year. A single additional skill identifier may be listed immediately following the five-character MOSC. As an exception, if the primary MOS is held for less than 1 year enter the primary specialty and the number of months the MOS and/or AOC was held. Secondary, additional MOS and/or AOC will not be listed if held for less than 1 year. 3. Army Regulation 15-185 (ABCMR) provides Department of the Army policy, criteria, and administrative instructions regarding an applicant’s request for the correction of a military record. The ABCMR begins its consideration of each case with the presumption of administrative regularity.
