The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he would like the time he served on active duty orders in a TPU included on his DD Form 214. 3. On 21 May 1991, he enlisted in the U.S. Army Reserve. 4. He was ordered to initial active duty training (ADT) on 21 August 1991. He was released from ADT effective 23 January 1992, upon completion of training. His DD Form 214 shows he completed 5 months and 3 days of net active service during this period. 5. He provided a request for orders showing his name for temporary duty to Fort McCoy, WI, for the period 31 May-14 June 2002. 6. He provided the AT Order Annex Report, which amended 65th Regional Support Command Order Number 004554 to show the period as 18 duty days, 8-25 June 2005. 7. On 10 June 2011, he was honorably discharged from the U.S. Army Reserve. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found relief is not warranted. 2. The Board noted there are no regulatory provisions for amending a DD Form 214 to reflect brief periods of active duty that are completed after the period covered by the DD Form 214. The Board determined item 12 of the applicant's DD Form 214 for the period ending 23 January 1992 accurately reflects the service the applicant had completed at the time the form was completed and should not be changed. 3. The Board advises the applicant that his Chronological Statement of Retirement Points should reflect all of the active duty service he completed outside of the period covered by his DD Form 214. The applicant will be provided a copy of this form for his review. If he finds any discrepancies, he may contact the U.S. Army Human Resources Command to request correction of any errors. 4. The Board concurred with the correction described in Administrative Note(s) below. Therefore, the Board determined the overall merits of this case are otherwise insufficient as a basis for correction of the records of the individual concerned. ADMINISTRATIVE NOTE(S): The applicant completed initial entry training and was awarded a military occupational specialty. When he was released from initial entry training, his service was uncharacterized in accordance with the regulation in effect at the time. The current regulation states a Reserve Component Soldier being released from initial entry training after being awarded a military occupational specialty will have a character of service of honorable. Reissue the applicant's DD Form 214 for the period ending 23 January 1992 to show his service was characterized as honorable. REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers upon retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214 (Certificate of Release or Discharge from Active Duty). The DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge.
