The applicant did not file within the 3-year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant through his Member of Congress states his social security number (SSN) is incorrect on his 24 December 1992 DD Form 214. He states a clerk made a typographical error when preparing his discharge document. He is now trying to obtain benefits from the Department of Veterans Affairs and requests correction to his DD Form 214. 3. Prior to enlisting in the United States Army Reserve (USAR) Delayed Entry Program the applicant and his recruiter completed DD Form 1966 series (Record of Military Processing – Armed Forces of the United States). He entered his SSN showing his last digit as . He certified with his signature that the information he provided on the form was true, complete, and correct to the best of his knowledge and belief. A government official also certified. The applicant provides his birth certificate and driver’s license to verify the applicant’s name and SSN. The applicant did not provide his Social Security card to the government official. The applicant and government official each signed the DD Form 1966 series on 15 May 1992. 4. On 22 May 1991 he enlisted in the USAR Delayed Enlistment Program. He and a government official completed DD Form 4 (Enlistment/Reenlistment Document – Armed Forces of the United States). His SSN is as shown on his DD Form 1966 series. 5. On 20 August 1991 he was discharged from the USAR Delayed Enlistment Program and immediately enlisted in the Regular Army for a period of 4 years. He and a government official each signed his DD Form 4/3 documenting his enlistment in the Regular Army. His SSN is as shown on his DD Form 1966 series. 6. Throughout his period of active service the documents filed within his official military personnel file contain his SSN as shown on his DD Form 1966 series with his SSN last digit as . There are two documents that were used to maintain his personal information, military training, and assignments. Both his DA Form 2-1 (Personnel Qualification Record), a manual form normally prepared by the unit clerk, and his electronic personnel qualification record contain his SSN as shown on his initial entrance document, DD Form 1966 series. 7. On 15 December 1992 personnel in the 199th Personnel Service Company published Orders Number 234-185 reassigning him to a U.S. Army transition point for transition processing and then discharging him from the Regular Army on 24 December 1992. This order contains his standard name line including his SSN as recorded on his DD Form 1966 series. 8. Accordingly, he was discharged as ordered on 24 December 1992. He received a DD Form 214 documenting his inactive and active service. In Block 3 of his DD Form 214, his SSN is recorded as shown on his DD Form 1966 series with his last SSN digit shown as . 9. As evidence to support his application, he provides his Social Security Administration card dated 17 December 2015 showing a different SSN from his military service SSN. The last digit is now shown as . BOARD DISCUSSION: 1. After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The applicant’s contentions, military record, and regulatory guidance were carefully considered. Evidence of record shows the applicant used the contested SSN consistently throughout his period of service. Based on the preponderance of evidence and in applying the presumption of administrative regularity, the Board determined the evidence presented insufficient to warrant recommendation for relief. 2. The applicant is advised that a copy of this decisional document, along with his application and the supporting evidence he provided, will be filed in his official military records. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 15-185 (Army Board for Correction of Military Records) prescribes the policies and procedures for correction of military records by the Secretary of the Army, acting through the ABCMR. The ABCMR considers individual applications that are properly brought before it. In appropriate cases, it directs or recommends correction of military records to remove an error or an injustice. The ABCMR’s jurisdiction under Title 10, USC, section 1552 extends to any military record of the Department of the Army. The regulation provides that the ABCMR begins its consideration of each case with the presumption of administrative regularity. The applicant has the burden of proving an error or injustice by a preponderance of the evidence. 3. Army Regulation 635-5 (Separation Documents) in effect at the time stated the DD Form 214 is a summary of a Soldier's most recent period of continuous active duty service. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. The general instructions stated the military personnel records jacket, official military personnel files, DA Forms 2 and 2-1 (Personnel Qualification Record) or the DA Form 20 (Enlisted Qualification Record) were the sources documents for preparing the DD Form 214. When preparing the DD Form 214 (Worksheet) personnel officers should review all available documents in the Soldier’s record. Before entering the Soldier’s name and SSN on his DD Form 214 (Worksheet), check records with the Soldier’s name and social security card when possible; otherwise, verify the accuracy of the SSN of record. 4. Army Regulation 635-8 (Separation Processing and Documents) currently in effect prescribes policy and procedural guidance relating to transition management. The DD Form 214 is a summary of the soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active duty, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The rules for completing the DD Form 214 state to verify the accuracy of a soldier’s SSN by reviewing the initial enlistment contracts and/or application for appointment. If the Soldier has had more than one SSN, list the other SSN of record in Block 18 (Remarks). Once a DD Form 214 has been issued, there are few exceptions requiring reissuance.
