APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 1610 (Request and Authorization for TDY Travel of DOD Personnel) FACTS: 1. The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states she served in Iraq (Erbil, Iraq). It was special mission travel and she was placed on routine temporary duty (TDY) orders. 3. The applicant provides DD Form 1610 which shows she was authorized travel from Kuwait City, Kuwait, to Erbil, Iraq, for the purpose of special mission travel with a proceed date of 8 January 2015 for approximately 32 days. 4. A review of the applicant’s service record shows: a. She enlisted in the Regular Army on 18 November 2013. b. Her Enlisted Record Brief shows she served in Kuwait from 8 December 2014 to 24 August 2015. c. Orders HO-288-0XXX, dated 15 October 20XX, deployed the applicant on a temporary change of station status to Arifjan, Kuwait, in support of Operation Enduring Freedom with a proceed date on or about 8 December 2014 for a period not to exceed 290 days. d. Orders HO-288-0XXX (A1), dated 11 June 20XX, amended Orders HO-288- 0XXX to read “Soldier will also perform duty at Qatar.” e. A NATO Travel Order, dated 15 October 2014, authorized the applicant to travel from the United States to and from Afghanistan, Africa, the Balkans, Belgium, Bulgaria, Canada, Czech Republic, Denmark, Estonia, France, Germany, Greece, Hungary, Iceland, Iraq, Italy, Latvia, Lithuania, Luxembourg, the Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Turkey, and the United Kingdom. f. Orders 230-0XXX, dated 17 August 20XX, discharged the applicant from active duty with an effective date of 24 August 2016. g. She was honorably discharged from active duty on 24 August 2016. Her DD Form 214 shows she completed 2 years, 9 months, and 7 days of active service. It also shows: * Block 12f (Foreign Service) – 8 months and 17 days * Block 18 (Remarks) – Service in Kuwait 20141208-20150824 5. By regulation (AR 635-8), the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. a. For item 12f (Foreign Service) enter the total amount of service performed outside the continental United States (OCONUS) during the period covered by block 12c (Net Active Service This Period). In addition, list periods of deployed service in block 18. b. For item 18 (Remarks), for active duty Soldiers deployed with his or her unit during their continuous period of active service, enter statement "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)." BOARD DISCUSSION: 1. After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found relief is warranted. 2. The Board found the DD Form 1610 provided by the applicant sufficient to confirm that she served in Iraq during her period of TDY service in Southwest Asia. The Board determined the applicant's DD Form 214 should be corrected to reflect that she was in Iraq. REFERENCES: 1. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.
