The applicant did not file within the three-year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. Sufficient evidence is contained in the applicant's records to administratively correct his DD Form 214 to show award of the Global War on Terrorism Service Medal without Board action. 3. The applicant states, in effect, he would like to have all of his deployments recorded on his DD Form 214, to include his time in Bosnia from 1 March 2000 – 1 March 2001 and Kuwait/Iraq from 13 April – 21 August 2001. 4. The applicant's records show the following: a. DD Form 4 (Enlistment Reenlistment Document Armed Forces of the United States), reflects he enlisted in the Regular Army on 27 April 1998. b. On 26 April 2002, he was honorably released from active duty and transferred to the U.S. Army Reserve Control Group (Reinforcement). He completed 4 years of net active service, with 4 months and 3 days of foreign service. c. Orders Number D-03-607635, issued by the U.S. Army Human Resources Command, St. Louis, MO, dated 28 March 2006, shows he was honorably discharged from the U.S. Army Reserve, with an effective date of 28 March 2006. 5. The applicant provides: a. Permanent Orders Number 54-1, issued by Headquarters III Corps and Fort Hood, dated 23 February 2000, shows a change in accounting classification. b. Permanent Orders Number 54-2, issued by Headquarters III Corps and Fort Hood, dated 23 February 2000, provides a Temporary Change of Station (TCS) from Fort Hood TX to Tuzla, Bosnia in support of SFOR7, Deployment in support of Operation Joint Forge Task Force Eagle, with an effective date of on or about 1 March 2000, for a period not to exceed 270 days. A roster of names is attached. c. A roster for Permanent Orders Number 54-2, lists the applicant's name and lists his Social Security Number (SSN). d. Permanent Orders Number 071-01, issued by Headquarters, 1st Cavalry Division, dated 12 March 2001, show a TCS to Kuwait, with an effective date from 13 April 2001 to 21 August 2001. e. A roster lists the applicant's name. (Note: the SSN listed is not the applicant's and his SSN is hand-written in). f. DD Form 214, for the period ending on 26 April 2002, shows the following information: * Item 12a (Date Entered Active Duty This Period): "27 April 1998" * Item 12b (Separation Date This Period): "26 April 2002" * Item 12f (Foreign Service): "4 months and 3 days" * Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) – * Army Lapel Button * Army Commendation Medal * Army Achievement Medal (3rd Award) * Army Good Conduct Medal * Armed Forces Service Medal * Army Service Ribbon * Item 18 (Remarks): lists no foreign service in Kuwait or Bosnia 6. An email provided by the Defense Finance and Accounting Service (DFAS) shows the applicant served in the following locations for a total period of 2 years, 2 months, and 19 days: * Bosnia-Herzegovina from 8 March 2000 to 20 September 2000 * Bosnia-Herzegovina from 21 September 2000 to 16 April 2001 * Kuwait from 17 April 2001 to 16 August 2001 * Kuwait from 17 August 2001 to 26 April 2002 BOARD DISCUSSION: 1. After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. DFAS records confirms the applicant’s deployment dates and locations. The Board determined there is sufficient evidence to grant relief. 2. Prior to closing the case, the Board did note the analyst of record administrative notes below, and recommended the correction is completed to more accurately depict the military service of the applicant. BOARD DETERMINATION/RECOMMENDATION: The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period ending 26 April 2002 by: * Block 12f – deleting the entry and adding “02 01 19” * Block 13 – adding the Iraq Campaign Medal, the Overseas Service Ribbon, and the NATO Medal; and * Block 18 – adding “Service in Bosnia/Herzegovina from 20000301 – 20010416” and “Service in Kuwait/Iraq from 20010417 - 20020422 I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. ADMINISTRATIVE NOTE(S): 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three-years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. AR 600-8-22 (Military Awards) provides Army policy, criteria, and administrative instructions concerning individual and unit military awards. The Global War on Terrorism Service Medal authorized for award to members of the Armed Forces of the United States who have participated in Global War on Terrorism operations outside of the Areas of Eligibility (AOE) designated for award of the Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Iraq Campaign Medal. All Soldiers on active duty, including Reserve Component Soldiers mobilized or National Guard Soldiers activated, on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized the Global War on Terrorism Service Medal. Only one award of the Global War on Terrorism Medal may be authorized to any individual; second and subsequent awards will not be awarded. 3. AR 635-5 (Separation and Processing Documents) states, the DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. It provides a brief, clear cut record of active duty service at the time of release from active duty, retirement, or discharge. a. Block 12f: From the enlisted record brief, enter the total amount of foreign service completed during the period covered in block 12c. b. Block 13: List awards and decorations for all periods of service in the priority sequence specified in Army Regulation (AR) 600-8-22 (Military Awards) Each entry will be verified by the Soldier's records. c. Block 18: Use this block for Headquarters mandatory requirements when a separate block is not available, and as a continuation for entries in blocks 11, 13, and 14. (1) Mandatory entry: "DATA HEREIN SUBJECT TO COMPUTER MATCHING WITHIN DOD OR WITH OTHER AGENCIES FOR VERIFICATION PURPOSES AND DETERMINING ELIGIBILITY OR COMPLIANCE FOR FEDERAL BENEFITS." (2) Mandatory entry: "SOLDIER (HAS) (HAS NOT) COMPLETED FIRST FULL TERM OF SERVICE." This information assists the State in determining eligibility for unemployment compensation entitlement."
