APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record under the Provisions of Title 10, U.S. Code, Section 1552) * DD Form 214 * Honorable Discharge Certificate * State Driver's License, 21 March 2019 FACTS: 1. The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states she was not aware that she was supposed to send in her DD Form 214 to be updated upon her discharge from the USAR. Her DD Form 214 currently shows only her basic training dates. She was an active member of the USAR from 31 January 1980 to 6 January 1998. She is in the process of applying for a Department of Veterans Affairs home loan and she needs her DD Form 214 to reflect the correct information. 3. She enlisted in the USAR on 8 December 1979 for a period of 6 years. 4. She was ordered to active duty for initial active duty training on 31 January 1980. 5. She was honorably relieved from active duty and returned to the control of her USAR unit on 7 June 1980. Her DD Form 214 shows in: * item 12a (Date Entered Active Duty This Period) – 31 January 1980 * item 12b (Separation Date This Period) – 7 June 1980 * item 12c (Net Active Service This Period) – 4 months and 7 days * item 12e (Total Prior Inactive Service) – 2 months and 3 days * item 28 (Narrative Reason for Separation) – Release from Initial Active Duty for Training under the Reserve Enlistment Program upon Completion of Military Occupational Specialty Training and a Minimum of 12 weeks of Initial Active Duty for Training 6. Her USAR Personnel Center Form 249-2-E (Chronological Statement of Retirement Points), 11 March 1994, contains no evidence showing she completed any additional periods of continuous active duty for 90 days or more after her initial active duty for training. 7. Headquarters, 77th USAR Command, Orders 121-25, 9 September 1994, transferred her to the USAR Control Group (Reinforcement) effective 23 November 1994. 8. USAR Personnel Command Orders D-01-800630, 6 January 1998, honorably discharged her from the USAR effective 6 January 1998. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found relief is not warranted. 2. The DD Form 214 only documents periods of active duty service. It is not used to document periods of inactive service performed as a member of a USAR unit. The Board determined the service dates on the applicant's DD Form 214 are correct. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), 15 August 1979, prescribed the separation documents which are prepared for individuals upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparing and distributing the DD Form 214. a. Paragraph 1-4 stated a DD Form 214 will be prepared for all personnel at the time of their retirement, discharge, or release from the Active Army. Personnel included are members of the USAR separated after completing initial active duty for training which resulted in the award of a military occupational specialty and after completing 90 days or more of continuous active duty, full-time temporary duty, or active duty support. b.
