The applicant states, in effect hi DA Forms 1380 for retirement points were turned in to HRC for processing, but due to the time limit specified in Army Regulation 140-185, paragraph 3-3, his forms were returned without action. He performed the duty, so he should get the credit. 2. The applicant provides: a. DA Forms 1380, for the period of 10 June 2019 to 29 June 2020, which shows he received a total of 112 hours of credit for training, while assigned to the 13th Infantry, 100th Battalion. b. Memorandum for Record, issued by HRC, dated 8 September 2020, shows the applicant’s request for drilling points was returned without action due to the DA Forms 1380 he submitted could not be re-created for past duty. 3. A review of the applicant’s service record shows: a. According to his DD Form 214, he entered active duty on 1 May 2018 and was honorably released from active duty upon the completion of his required active service. He completed 1 year of net active service this period with 4 years, 3 months and 13 days of total prior active service and 12 years, 2 months, and 23 days of total prior inactive service. b. Soldier's Management System from HRC, shows he completed duty on all the dates he listed on his DA Forms 1380’s, except for the following dates: 10 September 2019 (total 8 hours), 9-10 December 2019 (total 8 hours), and on 9-10 March 2020 (8 hours). c. The applicant is still serving in the USAR. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief was partially warranted. The Board found that, there may have been an incomplete accounting of his total retirement points. The Board noted that he completed duty on all the dates he listed on his DA Forms 1380s, except 10 September 2019 (total 8 hours), 9-10 December 2019 (total 8 hours), and on 9-10 March 2020 (8 hours). The appropriate agency to account for his missing retirement points is normally HRC. That office has returned his request without action due to the DA Forms 1380 he submitted could not be re-created for past duty. The Board determined that, as a matter of equity, the applicant’s record should be corrected by adding the missing retirement points. ? The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing he completed DA Forms 1380, showing the correct and appropriate rule, and they were forwarded to HRC in a timely manner meeting submission timelines for consideration. HRC will determine the appropriate amount of credit as a result of this correction. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to awarding him retirement points for 10 September 2019 (total 8 hours), 9-10 December 2019 (total 8 hours), and on 9-10 March 2020 (8 hours). Army Regulation 140-185 (Training and Retirement Point Credits and Unit Level Strength Accounting Records) prescribed the types of training and activities for which retirement points were authorized. The regulation stated that 15 membership points were earned for each year in an active status. Personnel on IDT were awarded 1 point for each troop program unit assembly of a minimum of 4-hours duration: a. Chapter 2-1 (Crediting and Awarding of Retirement Points) the limitations on the number of points that may be credited to a Soldier during an anniversary year are— * Maximum—365 (366 during leap year) points * No more than one retirement point may be awarded for any day in which the Soldier is on active duty; a Soldier in active service may not receive retirement points for other activities performed concurrently * Retirement points credited for activities other than active service or funeral honors duty may not exceed— * For any anniversary years closing before 23 September 1996: 60 retirement points. * For anniversary years closing on or after 23 September 1996, but before 30 October 2000: 75 retirement points. * For anniversary years closing on or after 30 October 2000, but before 30 October 2007: 90 retirement points. * For anniversary years closing on or after 30 October 2007: 130 retirement points. b. Inactive duty training (IDT) will be either 4 hours in length for one retirement point or 8 hours in length for two retirement points, with the exception of the 2-hour IDT funeral honors duty. c. Membership—Soldiers are awarded 15 membership points for each year in an active status. d. Chapter 2-2 (Criteria for earning retirement points). Retirement points may be earned by USAR Soldiers for active duty or duty in an active status for active duty for training (ADT), initial active duty for training (IADT), involuntary active duty for training (involuntary ADT), voluntary IDT, annual training (AT), IDT, membership points, and for other activities specified in this regulation. * Regularly scheduled unit training assembly include battle assemblies (BA) formally known as unit training assemblies * Re-scheduled training (RST) * Make-up assemblies for missed BA due to AT * Equivalent training (ET) in lieu of scheduled BA or RST * Additional training assemblies (ATA) * Two-hour funeral honor IDT * Training of individual Soldiers in non-pay status 2. Chapter 3-3 (DA Form 1380), states the purpose of this form is to record Inactive Duty Training (IDT). DA Form 1380 will be prepared for a unit Soldier who performs equivalent training (ET) or additional training with their unit subsequent to the scheduled Battle Assembly (BA). TPU units will retain one copy of the DA Form 1380 to post the appropriate entry into the automated drill attendance reporting software (ADARS) for the month’s report and then place in the appropriate Army records information management system file.
