The applicant did not file within the three-year time frame provided in Title 10, U.S. Code (USC), Section 1552 (b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his middle name is misspelled on his DD Form 214 due to a typographical error. 3. The applicant enlisted in the Regular Army on 31 May 1960. His DD Form 4 (Enlistment Record – Armed Forces of the United States) shows his middle name as "Xxxxxx." 4. The applicant was honorably released from active duty on 29 May 1963 and was transferred to the U.S. Army Reserve Control Group. Item 1 (Name) of his DD Form 214 shows his middle name as " Xxxxxx." 5. The applicant provides a certified copy of his certificate of birth, which shows his middle name as " Xxxxxx." 1 ABCMR Record of Proceedings (cont) AR20210009894 BOARD DISCUSSION: After reviewing the application and the supporting documents, the Board determined relief was warranted. Based upon the information reflected on the applicant’s enlistment contract, as well as other military documents in the record, the Board concluded the middle name entered on the applicant’s DD Form 214 was entered in error and warranted correction. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 by show his middle name as Xxxxxx, the same name as on his enclosed birth certificate. Title 10, USC, Section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) at the time established the standardized policy for preparing and distributing the DD Form 214. It states the purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge.
