The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states her DD Form 214 does not clearly state she served in Camp Casey, Korea from January 1998 through January 1999. She did not take leave during that time. She believes it was her “first deployment station” and she should have earned the “Korea National Defense Medal.” She would like the injustice corrected to further serve her country and fellow Veterans in the Veterans of Foreign Wars (VFW) and she would like it corrected to reflect her “foreign war” status in Korea. Once it is corrected, she can continue to serve her community through the VFW. 3. The applicant provides: a. The below listed documents to be referenced in her service record: * DA Form 2-1 (Personnel Qualification Record) * Enlisted Record Brief (ERB) * Orders B 192-003 dated 11 July 2003 * DD Form 214 b. The below listed documents that were provided during her separation. * DD Form 2648 dated 28 April 2003 * DD Form 93 dated 3 December 2002 * SGLV 8286 dated 3 December 2002 4. A review of the applicant’s record confirms she is eligible for award of the Korea Defense Service Medal that is not recorded on her DD Form 214. The award will be added to her DD Form 214 as an administrative correction and will not be considered by the Board. The Board will consider adding language regarding her foreign service in Korea. 5. A review of the applicant’s service record shows: a. She enlisted in the Regular Army on 30 July 1997. b. Her DA Form 2-1 shows her overseas service includes: * Korea from 27 January 1998 to 26 January 1999 – 1 year * Hawaii from 18 October 2001 to 17 January 2004 (applicant discharged from Hawaii on 30 August 2003) – 1 year, 10 months, and 13 days c. Neither her DA Form 2-1 nor her ERB list award of the Korea Defense Service Medal. d. Orders B 192-003, dated 11 July 2003, discharged the applicant from active duty with an effective date 30 August 2003. e. She was honorably discharged from active duty on 30 August 2003. Her DD Form 214 shows she completed 6 years, 1 month, and 1 day of active service. It also shows in Block 12f (Foreign Service) 2 years, 10 months, and 13 days of service. 6. By regulation, (AR 635-5) the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. a. Item 12f (Foreign Service) will show the total amount of foreign service performed during the period covered by block 12c (Net Active Service This Period). b. Item 18 (Remarks), for Soldiers who deployed with his or her unit during their continuous period of active service, enter a statement "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)." 7. By regulation (AR 600-8-22), the Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who served on active duty in support of the defense of the Republic of Korea. The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was partially warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. Unlike deployment to a combat area which is entered in Block 18 (Remarks), the foreign service is entered in Block 12f of the DD Form 214. The applicant served in Korea from 27 January 1998 to 26 January 1999 – 1 year and in Hawaii from 18 October 2001 to 17 January 2004 (applicant discharged from Hawaii on 30 August 2003) – 1 year, 10 months, and 13 days, for a total of 2 years, 10 months, and 13 days, which is already entered in Block 12f of the applicant's DD Form 214. The applicant does qualify for the KDSM based on service in Korea but there is no regulatory reason to enter Korea on the DD Form 214. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. ADMINISTRATIVE NOTE(S): A review of the applicant’s service records show she is authorized an additional award not annotated on her DD Form 214. As a result correct her DD Form 214 by adding the Korea Defense Service Medal. REFERENCES: 1. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) provides Army policy, criteria, and administrative instructions concerning individual military decorations. The Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who have served on active duty in support of the defense of the Republic of Korea. The area of eligibility (1) encompasses all land area of the Republic of Korea and the contiguous water out to 12 nautical miles and (2) all air spaces above the land and water area. The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense.
