The applicant did not file within the three-year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his SSN is incorrectly listed on his DD Form 214. 3. His DD Form 214 shows he served the Regular Army from 21 June 1980 through 9 September 1981. This form also lists his SSN as “xxx-xx-xxxx.” 4. He provides a tribal membership card and his social security card which list his SSN as “XXX-XX-XXXX." 5. Regulatory guidance states the DD Form 214 will reflect the record as it existed at the time of separation. ? BOARD DISCUSSION: 1. After reviewing the application and supporting documentation, the Board found relief is warranted. 2. The Board found the evidence shows a typographical error was made when the applicant's SSN was recorded on his DD Form 214. The Board determined the applicant's DD Form 214 should be corrected to show the SSN recorded on his social security card. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 to show the SSN recorded on his social security card. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation (AR) 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active duty service or control of the Active Army. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It established standardized policy for preparing and distributing the DD Form 214.
