The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he currently works for the Customs and Border Agency and wishes to gain credit for wartime service as a General Services Employee as well as correcting his DD Form 214. 3. Having 3 years, 4 months and 21 days of total prior active service, the applicant entered active duty this period on 13 May 1994. 4. On 30 November 2015, he retired honorably. Block 18 of the DD Form 214 he was issued shows he served in Iraq for the periods 16 April to 25 June 2005 and 1 April to 2 July 2007. 5. The applicant provides: a. Travel Voucher from the Defense Finance and Accounting Service (DFAS), dated 13 July 2005, that shows he was on temporary duty (TDY) and paid for lodging at a U.S. government facility for 138 days in Iraq from 6 February to 24 June 2005. b. Travel Voucher from DFAS dated 8 February 2007, that shows he was TDY and paid for lodging at a U.S. government facility for 3 days in Iraq from 13 January to 16 January 2007. The form further shows he was paid for meals and incidental expenses for 1 day in Kuwait from 16 January to 17 January 2007. c. Partial Travel Voucher from DFAS dated 17 July 2007, that shows he was TDY and money was reimbursed to his government charge card for the period 20 March to 4 July 2007. 6. Army Regulation 635-8 (Separation and Processing and Documents), establishes the standardized policy for preparing and distributing the DD Form 214. Chapter 5 contains guidance on the preparation of the DD Form 214. In block 18, for an active duty Soldier deployed with his or her unit during their continuous period of active service, enter the statement "Service in (Name of Country Deployed) From YYYYMMDD - YYYYMMDD)." BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found relief is warranted. 2. The Board found the evidence confirms the dates of service in Kuwait and Iraq claimed by the applicant. The Board determined his DD Form 214 should be corrected as he has requested.
