The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his DD Form 214 does not show his service in Korea. He served in Korea from 3 August 1956 to 3 November 1957 and would like his DD Form 214 to reflect that service. 3. His DD Form 373 (Consent, Declaration of Parent or Legal Guardian), 25 July 1955, shows his mother gave consent for him to enlist in the U.S. Army. 4. He enlisted in the Regular Army on 3 August 1955. 5. The U.S. Armed Forces Institute-Japan Form 3, 9 August 1957, shows he completed high school-level GED.? 6. U.S. Army Returnee-Reassignment Station, Fort Lawton, WA, Special Orders Number 232, 16 November 1957, show he returned from an overseas assignment aboard the U.S. Ship General William Mitchell on that date and was reassigned to Fort Riley, KS. The orders do not indicate the losing overseas assignment. (Note: The U.S. Ship General William Mitchell was a troopship that served with the U.S. Navy in the Korean War.) 7. Item 29 (Foreign Service) of his DA Form 20 (Enlisted Qualification Record) shows he served under the command of U.S. Army Forces Far East-Korea from 2 August 1956 through 16 November 1957, a period of 1 year, 3 months, and 15 days. 8. He was honorably released from active duty on 1 August 1958 and transferred to the U.S. Army Reserve Michigan Military District by reason of expiration term of service. He completed 2 years, 11 months, and 29 days of total active service. His DD Form 214 shows in: * item 24c (Foreign and/or Sea Service) – 1 year, 3 months, and 15 days * item 26 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) – "NONE" 9. He provided an email to an unidentified recipient, noting his 16 months of service in Korea from 3 July 1956 to 26 November 1967 that is not shown on his DD Form 214 and requesting verification of his service. BOARD DISCUSSION: 1. After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found relief is warranted. 2. The Board noted that after the applicant's service the regulation governing preparation of the DD Form 214 was updated to require an entry in item 24c documenting the last overseas theater in which a Soldier served. The Board determined it would be appropriate to add such an entry to the applicant's DD Form 214. 3. The Board concurred with the correction described in Administrative Note(s) below. ? ADMINISTRATIVE NOTE(S): The applicant is authorized correction of his DD Form 214 for the period ending 1 August 1958 to show award of the Korea Defense Service Medal without Board action. ? REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. The Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who served on active duty in support of the defense of the Republic of Korea. The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense. 3. Army Regulation 635-5 (Administrative Separation Procedures and Forms), 12 June 1956, prescribed the separation forms prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparation of the DD Form 214. The DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. It is important that information entered on the form be complete and accurate. The specific instructions stated for: a. item 24c, enter the total active duty service performed outside the continental limits of the United States for the period covered by the DD Form 214; and b. item 26, enter decorations, etc., awarded or authorized during the period covered by the DD Form 214 being prepared, omitting the authorities cited therein. c.
