APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214 for the period 17 August 1982 to 7 May 1986 * DD Form 214 for the period 26 March 2007 to 30 April 2021 * deployment orders and other documents showing her service in Kuwait FACTS: 1. The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. During the review of the applicant's military record, a DD Form 215 (Correction to DD Form 214), dated 1 July 2021, was located. This DD Form 215 corrected her DD Form 214 for the period ending 30 April 2021 by adding her service in Kuwait in block 18 (Remarks). Therefore, the portion of the applicant's request that pertains to her service in Kuwait will not be discussed further in this Record of Proceedings. 3. The applicant states she served in Germany during the period 1984-1986 but the information was omitted on her DD Form 214. She would like her DD Form 214 to be accurate. 4. The applicant enlisted in the Regular Army on 17 August 1982. 5. The applicant's Reserve Component Manpower System Automated Record Brief shows she served in Germany until May 1986. 6. The applicant was released from active duty and transferred to the U.S. Army Reserve (USAR) on 7 May 1986. Her DD Form 214 for this period of active service shows in block 12f (Foreign Service) she was credited with 1 year, 4 months, and 28 days of foreign service. The DD Form 214 does not show the country where the foreign service was performed. 7. The applicant continued her service in the USAR and on 26 March 2007, she entered active duty in Active Guard/Reserve status. She was retired on 30 April 2021 by reason of "sufficient service for retirement." BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was/was not warranted. The Board carefully considered the applicant's record of service, documents submitted in support of the petition and executed a comprehensive and standard review based on law, policy and regulation. Upon review of the applicant’s petition and available military records the Board determined there was sufficient evidence within the applicant’s record that supports she served in Germany. Evidence shows the applicant was stationed in Germany from 1983 until 1985. Based on this, the Board granted relief to correct her foreign service time on her DD Form 214. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending her DD Form 214 to show in: item 12f (Foreign Service) - 1 year 15 months and 29 days. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-8 (Separation Processing and Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It states for: a. Block 12f, enter the total amount of service performed outside the continental United States during the period covered by the DD Form 214 to include deployments. Additionally, list periods of deployed service in block 18. b.
