The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states her enlistment year and active duty time are incorrect. Her entry date was 7 June 1981 and should have 6 years instead of 5 years of service as a Reservist. 3. The applicant enlisted in the United States Army Reserve on 9 May 1981 for a period of 6 years. 4. The applicant was ordered to initial active duty for training effective 29 May 1981. She was relieved from active duty for training effective 26 July 1981. 5. A DD Form 220 (Active Duty Report), dated 26 July 1981, shows the applicant served on active duty from 29 May 1981 to 26 July 1981. 6. The applicant was ordered to active duty for training for advanced individual training effective 7 June 1982. She was relieved from active duty for training effective 20 August 1982. 7. Her DD Form 214 shows: * item 12a (Date Entered AD This Period) – 7 June 1982 * item 12b (Separation Date This Period) – 20 August 1982 * item 12c (Net Active Service This Period) – 2 months and 14 days * item 12d (Total Prior Active Service) – 1 month and 28 days * item 12e (Total Prior Inactive Service) – 8 months and 16 days 8. The applicant was transferred to the Ready Reserve on 7 March 1985. She was honorably discharged from the United States Army Reserve on 8 May 1987. BOARD DISCUSSION: 1. After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found relief is not warranted. 2. The Board found the applicant was issued a DD Form 214 upon completion of advanced individual training in accordance with regulation. As a member of a Reserve Component who received initial entry training under the Split Training Program, she was not authorized a DD Form 214 for her initial period of active duty in which she completed basic combat training. The applicant is advised that the DD Form 214 is only issued to document active duty service. It is not used to document subsequent periods of inactive Reserve Component service. The Board determined the applicant's DD Form 214 does not contain any errors related to the date she entered active duty or her length of service. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribes policies and procedures regarding separation documents, to include the preparation and issuance of the DD Form 214 (Certificate of Release or Discharge from Active Duty).
