IN THE CASE OF: BOARD DATE: 9 March 2022 DOCKET NUMBER: AR20210015417 APPLICANT REQUESTS: correction of his DD Form 214 (Report of Separation from Active Duty) for the period ending 27 December 1976 to show his primary military occupational specialty (MOS) as 71T (Equipment Maintenance Clerk) instead of MOS 71B (Clerk Typist). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: DD Form 149 (Application for Correction of Military Record under the Provisions of Title 10, U.S. Code, Section 1552). FACTS: 1. The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he was assigned to an MOS 71T position after arriving at his duty station in Germany in May 1979. He performed that duty until his discharge. He would like his MOS changed to reflect MOS 71T. 3. He enlisted in the U.S. Army Reserve Delayed Entry Program on 3 December 1973 for MOS 71B. He was discharged from the Delayed Entry Program on 27 December 1973 for immediate enlistment in the Regular Army. He enlisted in the Regular Army on 28 December 1973. 4. He was honorably released from active duty on 27 December 1976 and transferred to the U.S. Army Reserve Control Group (Reinforcement). He completed 3 years of total active service. Item 16a (Primary Specialty Number and Title) of his DD Form 214 shows the entry: "71B2O 74-04-17, Clerk Typist, Score 94 75-08," reflecting that he was awarded MOS 71B on 17 April 1974. This item does not show he held a secondary MOS and title. 5. His available records do not contain orders awarding him MOS 71T as his primary specialty during his active-duty period of service.? BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the applicant's military records, the Board found that relief was not warranted. The Board carefully considered the applicant's record of service, documents submitted in support of the petition and executed a comprehensive and standard review based on law, policy and regulation. Upon review of the applicant’s petition and available military records, the Board found insufficient evidence to support the applicant had a secondary or alternate military occupational specialty (MOS) awarded. His official military personnel record does not contain permanent orders awarding him a new or secondary MOS. The Board determined based on the evidence, the applicant separated from military service without being awarded a secondary MOS and title. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separations Documents), 20 August 1973, prescribed the separation documents that are furnished to individuals who are retired, discharged, or released from active military service, including members of Reserve Components on active duty for training or full-time training duty and U.S. Military Academy cadets. The DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. The DD Form 214 provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. The instructions for item 16a (Primary Specialty Number and Title) stated to enter the MOS code, title, and date of award. For enlisted personnel, enter the primary MOS evaluation score and date of score.
