The applicant states the DD Form 214 did not include a period of service from 6 April 2021 to 30 September 2021. He has provided the orders that amended his prior orders and confirms the extension from 6 April 2021 to 30 September 2021. 2. The applicant provides the above listed documents to be referenced in the service record. 3. A review of the applicant’s service record shows: a. He was appointed as a Reserve commissioned officer and executed an oath of office on 15 August 2015. b. Orders 121-182, dated 1 May 2015, ordered the applicant to active duty for a 4- year active duty commitment with a report date of 21 September 2015. c. Orders 311-0102, dated 7 November 2019, released the applicant from active duty with an effective date of 1 May 2020. He was assigned to the U.S. Army Reserve (USAR) Control Group. d. He was honorably released from active duty on 1 May 2020. His DD Form 214 shows he completed 4 years, 7 months, and 11 days of active service. He was assigned separation code MBK and the narrative reason for separation listed as “Completion of Required Active Service.” e. He was appointed as a Reserve commissioned officer on 2 May 2020 for an indefinite term. f. Orders HR-0226-00009, dated 13 August 2020, ordered the applicant to active duty for operational support for an active-duty period of 179 days with a report date of 8 September 2020 and an accumulative leave end date of 5 March 2021. g. Orders HR-0226-00009A01, dated 3 February 2021, amended the tour length to 210 days with a new end date of 5 April 2021. h. Orders HR-0226-00009A02, dated 7 April 2021, amended the tour length to 388 days with a new end date of 30 September 2021. i. Orders HR-0226-00009A03, dated 29 September 2021, amended the tour length back to 210 days with a 5 April 2021 end date. j. Orders 089-0257, dated 30 March 2021, released the applicant from active duty with an effective date of 5 April 2021. k. He was honorably released from active duty on 5 April 2021. His DD Form 214 shows he completed 6 months and 28 days of active service. The applicant digitally signed Block 21a (Member’s Signature) on 30 March 2021. He was assigned separation code MBK and the narrative reason for separation listed as “Completion of Required Active Service.” 4. On 27 July 2022, a member of the Defense Finance and Accounting Services (DFAS) staff provided email verification to confirm the applicant’s last day of active duty was 23 September 2021 (1 year, 16 days). DFAS provided the Leave and Earnings Statements (LES), available for review by the Board. 5. By regulation (AR 635-8), the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. a. Item 12a (Date Entered Active Duty (AD) This Period) states the data sources are enlistment contracts, initial order to active duty, active-duty order, previously issued DD Form 214, DA Form 1506 (Statement of Service – For Computation of Length of Service for Pay Purposes), and a complete review of the Soldier’s official record. Enter the beginning date of the continuous period of active duty for issuance of the DD Form 214, which a DD Form 214 was not previously issued. Do not depend on basic active service date for this data item. b. Item 12b (Separation Date This Period), states list the Soldier’s transition date. This date may not be the contractual date if the Soldier was separated early, voluntarily extends, is extended to make up lost time, or is retained on active duty for the convenience of the Government. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that partial relief was warranted. The Board carefully considered the applicant's record of service, documents submitted in support of the petition and executed a comprehensive and standard review based on law, policy and regulation. Upon review of the applicant’s petition, available military records and DFAS verification correspondence, the Board agreed with the DFAS verification correspondence along with the applicant’s leave and earning statements which show the applicant’s last day of active duty was 23 September 2021. Based on the evidence provided the Board granted partial relief for correction of Block 12b (Separation Date This Period) on his DD Form 214 for the service period ending 5 April 2021 to show his extension through 23 September 2021. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 for the period ending 5 April 2021 to reflect in item 12b (Separation Date This Period) 6 April 2021 to 23 September 2021. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to his extension from 6 April 2021 to 30 September 2021.
